Items must be paid for and collected by 5pm on the Monday after the auction, unless by prior arrangement. Shepherd’s can recommend a delivery company at an additional charge which will be agreed on an individual basis direct with them. Credit Card payments are subject to a 2% surcharge and Debit cards are subject to a 18p charge when used to pay for purchases.

All lots are subject to a 15% Buyer`s Premium and lots (where applicable) are subject to VAT at 20%. Commission and any taxes will be payable on successful bids. There is an additional 3% surcharge for Internet bidders on top of the normal buyers premium.

Most goods are subject to warrant and therefore have no reserve.

All bidders will be required to pay a fully refundable £100 deposit only to be retained if a bidder wins and fails to collect one or more items.

Please remember that by clicking to bid on the internet or indicating a bid in the room that these actions are a legal commitment to buy and when the hammer goes down you have purchased the goods at that price in the condition they stand in, if you are unable to establish the condition or value of the goods to your satisfaction then please do not bid, any goods purchased do not carry any warranty or guarantee, goods are sold as seen and the Sale of goods act does not apply to this sale

Exclusion of Liability

No guarantee or warranty is given or implied with any lot; the bidder/purchaser must have examined the goods prior to sale and assured himself/herself as to the condition of each item. Neither the Vendor of any lot nor the Auctioneers, their servants or agents is responsible for any errors of description or for the authenticity of any lot, nor has anybody in the employment of the Auctioneers has any authority to make or give, any representation or warranty in relation to any lot and any impled condidtions or warranties are excluded. Any description written down in the catalogue or stated at the time of sale is not guaranteed as being correct, the information is ascertained from the goods as seen. It is merely for information or identification purposes only. (The catalogue may contain inaccuracies or typographical errors.)The bidder must decide whether the description is correct and bid on what they have viewed and not on what has been described. All lots can be viewed on our viewing days (see home page for detailed days and times)

Live Auction sales are not classified as consumer sales (sale of goods act 1893 section 55 (7) therefore misrepresentation acts of law do not apply).

The auctioneer will regulate the bidding and decide in what increments the bid will be raised. The purchaser will be determined only when the hammer has gone down or the auctioneer says sold. Once the hammer has gone down the purchaser is in a legal binding contract to purchase the said lot for the amount bid plus the Auctioneers charges. Please note that your acceptance of these terms gives Shepherds your permission to complete all invoices on the card that you have provided for your deposit, unless alternative payment arrangements have been made with Shepherds. Please note that the item becomes the buyers responsibility from that time on.

All machinery must be removed from the machine side of the isolator by a qualified person and no wire may be left bare and must comply with the Health & Safety at work act 1974.

It is the purchaser`s responsibility to ensure that only a qualified engineer is used to disconnect and remove machinery they have bought.

No person who does not hold the correct licence can remove vehicles after purchase and should they do so the auctioneer will not be held responsible.

It is the responsibility of the purchaser to arrange for all goods purchased to be removed in the correct manner and within the time scale given. Collection days and times are given for each Auction. Should they fail to remove the goods within the time given they will be liable to forfeiture of any and all money paid (deposit) or storage and attendance fees.

Any goods not removed within the time scale given will be liable to re sale and any short fall will be charged to the original purchaser.

All successful bids will be liable to a buyers premium (amount will be in the catalogue or stated) and VAT will be added to the total at the standard rate at that time.

A deposit is required either at the time of obtaining your bidding card or registering on-line, any person not paying the require deposit will be excluded from making any further bids and the lot will be put back up for sale.

No goods can be removed or invoices paid while the auction is in progress and goods can only be removed when a paid invoice is handed to a member of staff.

No purchaser can remove goods without a member of staff being present and any disputes regarding what was purchased will be determined by the auctioneer. Their decision is final and cannot be challenged or disputed.

The purchaser must have all electrical or gas items checked by a registered engineer before connecting or using the goods.

All lots will be auctioned in the numerical order laid down in the catalogue. Save for vehicles and / or other items which will be clearly defined.

If goods are sold by tender then the bidder has to comply with all the above terms and conditions as it would relate to the sale being completed as a tender. The tender must be completed and returned within the time scale stated in the catalogue and the appropriate deposit must accompany the tender form.

Should there be identical highest bidders the auctioneer reserves the right to ring both or all parties and offer them the opportunity to increase their bid.

Should the tender allow a bid in its entirety (ie all goods) the auctioneers reserves the right to accept that bid over all the individual bids should he feel that doing so would reduce costs which in turn would result in more money for the client.

Any person not completing the purchase after either bidding or tendering for the goods lotted, they will lose the deposit given and the goods will either be re advertised and sold or offered to the under bidder, should the auctioneer incur costs or the client receive less that the original amount tendered, the original bidder will be liable for shortfalls.

ALL GOODS ARE SOLD STRICTLY SUBJECT TO THESE TERMS & CONDITIONS. ANY PERSON WHO FEELS THEY CANNOT COMPLY WITH THESE TERMS MUST NOT BID.

THESE TERMS WILL BE DISPLAYED AT ALL AUCTIONS AND ALL GOODS WILL BE SOLD SUBJECT TO THEM. A COPY OF THESE CONDITIONS CAN BE FORWARDED TO ANY PERSON WHO REQUESTS A COPY IN WRITING.
