Terms & Conditions for On-Line & On-Site Bidders

FULL PAYMENT BY TUESDAY, JANUARY 21ST

ALL PURCHASES MUST BE REMOVED FROM FACILITY BY JANUARY 24TH OR BY ARRANGEMENT!

1.     FULL PAYMENT DUE BY CASH, DEBIT, WIRE TRANSFER, BANK DRAFT OR E-TRANSFER BY JANUARY 21ST. PLEASE NOTE THAT CREDIT CARDS CAN NOT BE USED FOR THIS SALE. 

2.     While descriptions are believed to be correct, the auctioneers or the Seller make no warranties or guarantees expressed or implied, as to the genuineness, authenticity of, or defect in any lot and will not be held responsible for advertising discrepancies or inaccuracies.  All lots are sold “AS IS” and “WHERE IS”.  No warranties are made as to the merchantability of any items or their fitness for any purpose.

3.     It is the Purchaser’s responsibility to secure all safety equipment to meet all applicable government safety standards in removing, transporting or using items purchased.

4.     PST & GST taxes will be added to the purchase of all items.  Dealers who purchase for resale must file their resale permit numbers.

5.     Purchaser does hereby indemnify and hold harmless auctioneer and Seller from any and all damages, claims or liabilities from injuries to persons or property of any type whatsoever caused during the sale, by the removal, transportation or use of items purchased.

6.     Auctioneers and Seller shall have no liability to the Purchaser due to non-delivery of any item for any reason.  Liability shall be limited to return to the Purchaser the monies deposited for non-delivered items.

7.     ITEMS MUST BE REMOVED FROM THE PREMISES BY JANUARY 24TH, 2014 OR BY ARRANGEMENT.  No item can, on any account, be removed before termination of the sale.  Removal shall be at the expense, risk and liability of the purchaser.  Auctioneers shall not be responsible for items not removed within the time allowed.  If equipment is NOT REMOVED within specified removal time, Purchaser shall be liable for any moving and storage costs incurred and, if not so removed, the ITEMS SHALL BE DEEMED ABANDONED! THIS RULE DOES NOT HAVE ANY EXCEPTIONS!   

8.  If any dispute arises between two or more bidders, the auctioneers may at his discretion, re-offer the item for bid.

9. The auctioneer reserves the right to group one or more lots into one or more selling lots, or to add to or delete lots at his sole discretion.  The auctioneer reserves the right to reject any bid which is only a fractional advance over the proceeding bid.  

10. This auction will be simulcast on Bidspotter.com.  All Internet bidders are subject to Terms of Sale as well as Internet bidding terms.

A 15% Buyer's Premium applies to all onsite bidder sales.
A 18% Buyer's Premium applies to all online bidder sales.

AMMONIA PUMP DOWN WILL BEGIN ON JANUARY 20TH AT NO COST TO THE PURCHASER. 

Purchasers claiming exemptions from taxes shall provide proof of their entitlement to claim such exemptions. In the absence of proof, all taxes must be paid
