  1. The sand salt mix is located at the Public Works Campus, 53 Newtown Road, Danbury CT, and is available for review by calling The Department of Public Services Superintendent, Timothy P. Nolan, (203) 797-4605.

 

  1. The estimated composition of the mix is between 3 to 1 and 50/50 sand to salt.  This composition is an estimated approximate and is not guaranteed.

 

  1. The total amount of sand salt mix is estimated at 7000 to 8000 tons.  This total weight is an estimated approximate and is not guaranteed.

 

  1. The sand salt mix will be sold to the highest bidder in US dollars per ton, and at a minimum of 250 ton lots. 

 

  1. The first successful High bidder will have the option to purchase additional sand salt or the entire sand salt stock pile at the initial High bid.  If necessary, additional sand salt will be auctioned off until the entire sand salt stock pile has been sold.

TERMS & CONDITIONS

By bidding on any item(s), the bidder shows acceptance of the terms & conditions of the auction. 

The Auctioneer assumes no responsibility for the safety or condition of any item after the fall of the hammer. Purchases must be paid in full no later than 3:00 p.m. on the day of the auction. Unless other arrangements have been made in writing.  

DESCRIPTIONS / CONDITION - The Auctioneer has put forth every effort to provide as accurate a description of all items in preparing this auction catalog.  The Auctioneer shall not be responsible for the correct description, authenticity, genuineness of, or defect in any lot and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of incorrectness, error in cataloguing or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed to public exhibition are sold "as is" "where is" with no guarantees implied and without recourse. All sales are final. It is the bidders responsibility to determine the exact condition of each item.   Printed statements of description are provided in good faith and are matters of opinion.

BIDDER – Acknowledges that the auction site is a potentially hazardous area. Every person at the auction site, during & after the sale shall be deemed to be at his or her own risk. Note: All bidders are bound by their signature on the bidder’s registration. Please read these terms carefully.

ADDITIONS / WITHDRAWALS - The Auctioneer has sole discretion to reject any and all bids and reject a nominal advance and reserves the right to withdraw from sale any items listed or to sell items not listed.  The auctioneer reserves the right to group one or more lots into one or more selling lots or to subdivide into more selling lots.   Wherever the best interest of the seller will be served, the Auctioneer reserves the right to sell all of the items listed in bulk or individually or subject to confirmation of owner.  

 

BIDDING - All bidders are required to have a Bid Number obtained at the time of registration from the Auction office.   All bidders (both on-site and internet) must provide their name, address, daytime phone number and e-mail address.  This is to insure good communication between The Hamilton Group and the bidder throughout their transactions. The first successful High bidder will have the option to purchase additional sand salt or the entire sand salt stock pile at the initial High bid.  If necessary, additional sand salt will be auctioned off until the entire sand salt stock pile has been sold.

 

PREMIUM / SALES TAX - A 10% Buyers Premium will be charged on all onsite purchases.  Internet Buyer's Premium is 13.5% when applicable.

PAYMENT- should be in CASH, (COMPANY OR PERSONAL CHECK WITH A BANK LETTER OF GUARANTEE), or CASHIERS CHECK, made payable to The Hamilton Group, LLC. The full purchase price on all lots sold to the same buyer must be paid to a representative of the Auctioneer on the day of the auction by 3:00PM and before the removal of any items unless other wise announced. In default of payment of bills in full within the time herein specified, the auctioneer in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damage.  Lots not removed and or paid for within the time specified herein will be considered abandoned and may be resold at public or private sale without further notice, and deficiency together with all expenses and charges of re-sale, will be charged to the defaulting purchaser.

DISPUTES - if any dispute arises between two or more bidders, the Auctioneer may decide the same or may immediately put the lot up for sale again and resell to the highest bidder. The Auctioneer shall be the final judge in all-bidding disputes and shall determine the top bidder. The decision of the auctioneer shall be final and absolute.  RECORDS - The record of sale kept by the auctioneer and bookkeeper will be taken as final in the event of any dispute

LOT COUNTS . Where items are sold by estimated count, measure or weight, the purchaser will be billed for and required to pay for the estimated count, measure or weight.  If, any shortage exits, the purchaser will receive a refund at the rate of purchase. If there is excess, the purchaser is required to take items and pay for the excess, at the rate of purchase.

REMOVAL –Purchases will be delivered only on presentation of paid bill.  Auctioneer shall not be responsible for goods not removed within the time specified and shall have the option of removing and storing at the expense and risk of the purchaser any article purchased but not paid for and removed within the specified time. CLAIMS - No claims will be allowed after goods are removed from premises Successful bidders will be required to pick up the sand salt mix from the Danbury Public Works Campus.  Bidders will provide dump trucks, with a minimum body capacity of 7 cubic yards, legally registered and driven by CDL licensed drivers that will be loaded out by the City of Danbury pay loader and operator.  The City of Danbury pay loader includes a calibrated loading scale for accurate load weights.  A written receipt of individual load out weight and total weight will be provided.   

Successful bidders will have a maximum of two weeks to pick up their material lots.  The City of Danbury reserves the right to sell lots that have not been picked up after the two week maximum pick up period.  

RESERVES - The Auctioneer reserves the right to reject any and all bids.  On lots upon which there is a reserve, the Auctioneers shall have the right to bid on behalf of the seller. 

AGENT - The Auctioneer is acting as agent only and is not responsible for acts of the principals
