By bidding on any item(s), the bidder shows acceptance of the terms & conditions of the auction

The Auctioneer assumes no responsibility for the safety or condition of any item after the fall of the hammer. All property shall be removed from the premises by the Bidder at her/his own risk and expense within the time period announced. Purchases must be paid in full no later than 2:00 p.m. on the day following the auction. Unless other arrangements have been made in writing.

Removal: No items will be removed from the sale site until the conclusion of the auction. Removal will be on day of sale, until the conclusion of the sale and thereafter by appointment. After that Removal Will Be By Appointment On Sunday 10/14 & Monday 10/15. All items must be removed no later than 3:00 p.m. on Monday 10/15/12. Any Items left onsite beyond 10/15/12 will be considered abandoned and may be resold. You will be responsible for any deficiency in the price realized.
DESCRIPTIONS / CONDITION - The Auctioneer has put forth every effort to provide as accurate a description of all items in preparing this auction catalog. The Auctioneer shall not be responsible for the correct description, authenticity, genuineness of, or defect in any lot and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of incorrectness, error in cataloguing or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed to public exhibition are sold "as is" "where is" with no guarantees implied and without recourse. All sales are final. It is the bidders responsibility to determine the exact condition of each item. Printed statements of description are provided in good faith and are matters of opinion.
BIDDER ? Acknowledges that the auction site is a potentially hazardous area. Every person at the auction site, during & after the sale shall be deemed to be at his or her own risk. Note: All bidders are bound by their signature on the bidder?s registration. Please read these terms carefully. Large Items to be determined by the auctioneer need to be moved by a licensed & insured rigger. The rigger must have a $2,000,000.00 liability policy and name Torrington Metal Products & The Hamilton Group as additionally insured.
ADDITIONS / WITHDRAWALS - The Auctioneer has sole discretion to reject any and all bids and reject a nominal advance and reserves the right to withdraw from sale any items listed or to sell items not listed. The auctioneer reserves the right to group one or more lots into one or more selling lots or to subdivide into more selling lots. Wherever the best interest of the seller will be served, the Auctioneer reserves the right to sell all of the items listed in bulk or individually or subject to confirmation of owner.
BIDDING - All bidders are required to have a Bid Number obtained at the time of registration from the Auction office. All bidders (both on-site and internet) must provide their name, address, daytime phone number and e-mail address. This is to insure good communication between The Hamilton Group and the bidder throughout their transactions.
PREMIUM / SALES TAX - A 10.0% Buyers Premium will be charged on all onsite purchases. Internet Buyer's Premium is 15% when applicable. Sales tax will be charged to the buyer unless Auctioneer is provided with a copy of their Sales Tax Exemption form at time of registration. No Tax Is Collected On The Sale Of Vehicles.
PAYMENT- should be in CASH,Wire Transfer, (COMPANY OR PERSONAL CHECK WITH A BANK LETTER OF GUARANTEE), or Bank CHECK, made payable to The Hamilton Group, LLC. Invoices under $1000.00 can pay with Visa or Mastercard. The full purchase price on all lots sold to the same buyer must be paid to a representative of the Auctioneer on the day of the auction or by the folling day by 2:00 and before the removal of any items unless otherwise announced. In default of payment of bills in full within the time herein specified, the auctioneer in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damage. Lots not removed and or paid for within the time specified herein will be considered abandoned and may be resold at public or private sale without further notice, and deficiency together with all expenses and charges of re-sale, will be charged to the defaulting purchasers. Online bidders credit cards will Be charged on the following day Unless Other Payment Options Have Been Discussed Prior.
DISPUTES - if any dispute arises between two or more bidders, the Auctioneer may decide the same or may immediately put the lot up for sale again and resell to the highest bidder. The Auctioneer shall be the final judge in all-bidding disputes and shall determine the top bidder. The decision of the auctioneer shall be final and absolute. RECORDS - The record of sale kept by the auctioneer and bookkeeper will be taken as final in the event of any dispute
LOT COUNTS / Condition / Vehicle Mileage Is Just An Estimate And No Allowance For Discrepancies From Printed Or Posted Material Will Be Given. ALL VEHICLES SOLD IN AN AS IN CONDITION.
REMOVAL - Shall be at the expense, liability and risk of the purchaser. Purchases will be delivered only on presentation of paid bill. Auctioneer shall not be responsible for goods not removed within the time specified and shall have the option of removing and storing at the expense and risk of the purchaser any article purchased but not paid for and removed within the specified time. CLAIMS - No claims will be allowed after goods are removed from premises
RESERVES - The Auctioneer and or the University reserves the right to reject any and all bids. On lots upon which there is a reserve, the Auctioneers shall have the right to bid on behalf of the seller.
AGENT - The Auctioneer is acting as agent only and is not responsible for acts of the principals.

*** VEHCILES MUST BE TOWED FROM THE SITE UNLESS YOU HAVE A VALID DEALERS PLATE. YOU MAY NOT GO REGISTER THE CAR AND COME BACK AND EXECT TO DRIVE IT OFF THE SITE. PER UNIVERSITY POLICY THEY MUST BE TOWED. IF YOU ARE BIDDING OUT FROM OUT OF STATE. MOST VEHCILES ARE SOLD WITH A CERTIFICATE OF ORIGIN CHECK WITH YOUR LOCAL MOTOR VEHICLE DEPARTMENT TO SEE IF THEY WILL HONOR THESE. WE CAN NOT GARUANTEE THAT THEY WILL SO BUY AT YOUR OWN DESCRETION.
