Terms and Conditions

By registering to Bid online, You are agreeing to all of the
following Terms and Conditions:
All sales are final, all items are sold as-is, where-is.
Scrap Masters and CWR reserves the right to remove any item
before actual sale for any reason. All bids are per lot as
numbered per biddspotter.com website.
Full Payment is Due within 48 hours of receiving invoice of
win. You will not be permitted to remove items from the
premises until paid in full. Purchaser has four (4) days to
remove said items per invoice, from Scrap Masters Premises,
between the hours of 8am to 5pm Wed, Thurs, Friday and 8am
to 2pm on Saturday. Must bring invoice to claim items.
Removal of items is the responsibility of the Purchaser,
shipping will not be available.

10% Buyers Premium on all sales.

Cash or Cashiers Check is the only form of payment that will
be accepted.

Inspection of auction lots will be on Friday-March 16, 2012
between the hours of 9am to 4pm and Tuesday- March 27, 2012
between the hours of 9am to 4pm at the address provided on
the front page of the website.

1. As a Bidder, placing a bid is a binding contract.
Once you place a bid, and if you win, you will be obligated
to buy the product at the said price you indicated as your
bid. Placing a bid on this Site, and winning, then not
paying for the product could be illegal, and prosecution can
result. The Owner/Sellers of property sold through this Site
reserve the right to reject any and all bids, in their sole
discretion. Only the laws of the State of Michigan shall
apply and shall govern all actions accordingly. Buyer agrees
to abide by all such Michigan laws
2. Absolutely no warranty or representation, written or
oral, is given with any lot. All statements contained in
the biddspotter.com website or marketing material or by
Auctioneers, or in any bill of sale, invoice or elsewhere as
to description, size, quantity, quality, capacity, model,
serial number, measurements or condition are approximated
statements and all shall not be deemed to be representations
or warranties, oral or written, with respect to any lot. No
Sale is invalid or made void by reason of any flaw in a lot
or by reason of a lot being incorrectly described and Scrap
Masters will not be liable and no compensation will be paid
for any such fault or error of description.
3. Purchaser hereby agrees to defend, indemnify and
hold harmless Scrap Masters and its employees from and
against any and all liabilities, judgments, claims,
settlements, losses, damages, penalties, obligations and
expenses, including attorney?s fees and expenses and other
professional fees and expenses, incurred or suffered by such
persons arising from, by reason of, or in connection with
any loss, damage or injury to person or property arising
from, by reason of or in connection with the Items sold
hereunder. This indemnification shall survive delivery of
items to any subsequent sale or other transfer of the items
to a third party.
4. Persons attending during inspection, sale or removal
of items assume all risks of damage of or loss to person and
property and specifically release the Auctioneer from
liability therefor, the Auctioneer nor his/her principal
shall be liable by reason of any defect in or condition of
the premises on which the sale is held.
5. No trucks are to be left running in an enclosed
building. Scrap Masters is not liable for personal
belongings left on premises.
6. Theft will not be tolerated and Auctioneer reserves
the right to inspect all trucks, toolboxes and rigger cases,
etc. Instances of theft will result in immediate termination
of removal privileges and full prosecution by law. All
quantities must be checked prior to removal, as adjustments
will not be made thereafter.
7. It is the Purchasers responsibility to secure all
safety equipment to meet all applicable government safety
standards in using or removing items purchased. Scrap
Masters will not be liable for certain items containing
residual chemicals and/or hazardous materials. Scrap
Masters will not be liable for any damages or fines incurred
for improperly securing items to trailers or truck beds or
the like to haul purchased items.
8. Any surface or structural damage to the premises
including but not limited to the walls, ceilings, floors,
overhead doors, gates and/or any other item(s), etc. will be
the undersigned's sole responsibility. The undersigned will
not be permitted to leave with its purchases until repairs
are made.
9. Scrap Masters will load large items purchased for
Purchaser if needed with our hi/lo with it being known Scrap
Masters will not be liable for any damage that may be
incurred while doing so for the Purchasers convenience.
10. No item(s), no matter how small, may be removed
while the auction is in progress.
11. The Auctioneer will impose a Buyer's Premium on all
items sold. The Buyer's Premium is a percentage that is
added to the final purchase price of any item.
12. INSURANCE - All Buyers, or the Buyer's riggers must
provide Scrap Masters Employee a certificate of insurance in
amounts acceptable to the above parties prior to removal of
any large machinery and equipment on Scrap Masters premises
prior to removal of purchased items, if being loaded with
equipment that is not Property of Scrap Masters.
13. Auctioneer cannot, and will not, be held responsible
for any interruption in service, errors, and/or omissions,
caused by any means and does not guarantee continual,
uninterrupted or error free service or use of the Site.
Bidder acknowledges that this auction is conducted
electronically and relies on hardware and software that may
malfunction without warning. The Auctioneer, in its sole
discretion, may void any sale, temporarily suspend bidding
and re-sell any item/lots that were affected by any
malfunction. The decision of the Auctioneer is final.
14. ADDITIONAL TERMS AND CONDITIONS ? Scrap Masters or
CWR may modify or supplement these terms and conditions of
sale at the sale site or via Bidspotter.com website at
anytime.
