The Wythe family will be available for people to collect their purchased items August 3 - 10th, 2013 from 9 am until 8 pm.
After August 10th it is by appointment only.
All items must be collected by September 3rd, 2013 or they will be resold.
Please note: There will be absolutely NO cell service at this sale as it is located in a valley.
1. Registration A VALID CREDIT CARD will be used for registration purposes only.
2. The auctioneer has the right at his absolute discretion to refuse any bid. The highest bidder shall be the buyer at the hammer price.
3. Dispute between bidders - If any dispute arises between two or more bidders, the auctioneer may decide the same or may immediately put the lot up for sale again, and resell to the highest bidder. The decision of the auctioneer shall be final and absolute.
4. All articles of merchandise are offered As Is and Where Is in units of measure as announced at the time of sale. No claim will be considered for allowance adjustment of recession of any sale based upon the failure of the property to correspond to any particular standards or expectations of the buyer; Auctioneer may state the year of manufacture of certain equipment, however it is the responsibility of the buyer to ascertain, by his own means the correctness of year, model prior to bidding. The Auctioneer reserves the right to group, modify, increase, diminish or delete lots at his sole and absolute discretion.
5. Condition of items sold - The auctioneer shall not be responsible for the correct description, authenticity, genuineness of, estimated selling price of, or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloguing, or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold “as is” and without recourse.
6. Manner of payment – Wire transfers, a cashier’s check or personal check. To write a personal cheque for purchases online, a letter of guarantee from your financial institution is needed to guarantee funds to approve your desired bid limit and to verify available funds. You must pay for purchases with a cheque based on this account only, and no stop payment will be issued. Letters can be sent via email srtaylor@mymts.net or fax to 204-877-3412. An Invoice will be emailed confirming your bid after the auction has been completed. When you receive the invoice you have 24 hrs to contact Ross Taylor Auction Service at 204-877-3834 to make payment arrangements. Payment must be made by the next banking day following the auction. Ross Taylor Auction will be posting the US Exchange rate for this auction on Friday August 2nd,2013 Ross Taylor Auction Service will be charging a US Exchange rate of 1.0835 thus a item you purchase for $ 1000 Canadian will cost you $ 1083.50 US
7. Sales Tax - Only applicable items will be charged sale tax.
8. Insurance Purchases become the responsibility of and shall be and remain at the risk of the purchaser immediately upon acceptance of his bid. It shall be the responsibility of the purchaser to insure his purchases immediately.
9. Removal - shall be at the expense, liability, and risk of the purchaser. Ross Taylor Auction Services are not responsible for any shipping and or pick-up related costs. Auctioneer shall not be responsible for goods not removed within the time specified. NO LOT MAY BE TAKEN FROM THE WYTHE FARM UNTIL CHECKED OUT BY A WYTHE FAMILY MEMBER. 10. Claims - No claims will be allowed after goods are removed from premises.
11. Personal and property risk - Persons attending during exhibition, sale or removal of goods assume all risks of damage of or loss to person and property and specifically release the auctioneer from liability therefore. Neither the auctioneer nor his principal shall be liable by reason of any defect in or condition of the premises on which the sale is held.
12. Records - The record of sale kept by the auctioneer and clerk will be taken as final in the event of any dispute.
13. Ross Taylor Auction Services is providing Internet pre-auction and live bidding as a service to bidder. The Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall bidder have any kind of claim against Ross Taylor Auction Services or anyone else if the Internet service fails to work correctly before or during the live auction. Ross Taylor Auction Services will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid.
14. Ross Taylor Auction Services reserves the right to withdraw or re-catalog items in this auction.
15. ALL SALES ARE FINAL.
16. GST Sales Tax 5% is charged on these tractors that are under 60 hp. Plus GST and 8% MB PST is charged on all applicable items in this sale
