Terms and conditions for Riada Equipment LTD, Inc Food & Chemical Processing Equipment Auction closing on January 19, 2012

1. Buyer?s Premium: 10% plus Internet Fee 3% - 13% Total
2. Buyer will have to Register with Bidspotter and be approved before bidding. By registering and bidding, the bidders acknowledge they understand and agree to the terms and conditions of the auction. Furthermore bidders acknowledge that by bidding on an item they are entering into a legal contract with Riada Equipment LTD. Buyers are required to complete their research, due diligence, and inspection on the property real or personal, being offered at auction prior to submitting their auction bid. No returns are allowed.
3. Payment: Only Cashier?s Check or Wire Transfer in USD. All Buyers with successful bids will be invoiced within 24 hours of end of Auction. Full Payment is due in seller?s office by, Wednesday, January 25, 2012. No equipment will be removed from the sale site until payment is received by Riada Equipment LTD. No Exceptions. Wiring instructions will be sent with your invoice, 24 hours after auction ends.
4. All Equipment is sold ?AS-IS-WHERE-IS? ?In Place? with all faults ? no warranties, representation or guarantees, expressed or implied ? whatsoever of any kind.
5. The seller reserves the right to withdraw any items from the sale, group items into lots, sub-divide lots into separate items and sell items in bulk. The seller also reserves the right to accept or reject any and all bids.
6. Removal: All equipment must be removed by Friday, February 3, 2012, unless arrangements are made by Wednesday, January 25, 2012.
7. Removal & Loading: NO CHARGE FOR LOADING. If palletizing and/or crating are needed, will quote on a per item basis.
8. Sales Tax: If applicable will be the responsibility of the buyer.
9. Any equipment remaining after February 3, 2012, will be considered abandoned and may resold without notice and/or public or private sale.
10. Purchaser does hereby indemnify and hold harmless seller from any and all damages, claims, or liabilities from injuries to persons or property of any type whatsoever caused by the removal of items purchased.
11. Seller shall have no liability to the purchaser due to non-delivery of any item for any other reason than to return to the purchaser the monies deposited for non-delivered items.
12. While descriptions are believed to be correct, the seller makes no warranties or guarantees expressed or implied, as to the genuineness, authenticity of, or defect in any lot and will not be held responsible for advertising discrepancies or inaccuracies. No allowance will be made or no sale of any correcting of imperfection not otherwise noted. No allowance will be made for damaged items as all items are sold as is and without recourse. Everything sold ?AS IS? and ?WHERE IS?. No warranties are made as to the merchantability of any items or their fitness for any purpose. All items must be removed no later than Feb.3, 2011.
