Acceptable forms of deposit (25% or greater) for online bidders is:  Wire Transfer in advance of the sale.

Wires must be received no later than 4:00 PM EST on the day before the auction.
Please remember to include your company name and/or bidder number in the wire for identification. We recommend that you send an odd amount and then email us at auctionsaleinfo@gmail.com so that we can identify your wired deposit for credit to your account.

As soon as we receive your deposit, you will be authorized to bid.

BY PLACING A BID(S) IN PERSON OR ONLINE YOU ACKNOWLEDGE AND ACCEPT THE TERMS OF SALE. - All Proxy / Absentee bids must be received no later than 4:00 Eastern Standard Time on the day before the auction.

All Bids (proxy OR on line) must be accompanied by a deposit equal to or greater than twenty five percent (25%) of your total bids. Without this deposit your bids will NOT be considered qualified bids.

NO WARRANTIES. Every item and lot in the "Auction" is sold: (a) AS IS, WHERE IS AND SOLD WITHOUT RECOURSE", and (b) with no warranties, guarantees or representation of any kind or variety, whether expressed, written, implied or otherwise.

INSPECTION / REPRESENTATION: If you choose to bid without inspecting the items, your bids are in accordance with your investigation and due diligence NOT our descriptions or representations. You assume all risks associated with bidding without inspection.

BALANCE OF PAYMENT: If you are a successful on line or proxy bidder an invoice will be emailed to you the evening of the auction. The balance indicated on the invoice must be received via wire transfer by 4:00 PM on Monday August 15th. In the event this sum is NOT received, your deposit may be subject to immediate forfeiture, without recourse of any kind and the awarded item(s) sold to another party without further notice.

REFUND: In the event the Proxy / On line Bidder is not successful, the deposit amount shall be returned via the same method in which it was tendered within five business days of the auction date. NOTE: If you wire us a deposit and want it returned via wire, you must email us your wire transfer information, we cannot "reverse" a wire.

SALES TAX. 8% South Carolina Sales tax will be charged and collected by Randy L. Fridkis Auctions, LLC on all purchases. To be exempt from sales tax, the "Bidder" must present a properly executed sales tax exemption form, along with any and all locally required documents acceptable to the state of South Carolina. To qualify for any available exemption, the Bidder must sign any form required by Randy L. Fridkis Auctions, LLC. Out of State purchasers will not be responsible for sales tax, as long as your trucker provides a straight bill of lading showing shipment out of state via common carrier.

ADDITION TO OR WITHDRAWAL FROM SALE. Randy L. Fridkis Auctions, LLC reserves the right: (a) to withdraw from the sale any item or items; (b) to add and sell any item or items not listed; (c) to group one or more items or lots into one or more selling lots; (d) to subdivide any lots into two or more selling lots; and (e) to sell any/all of items listed in bulk.

CONDITION OF ITEMS SOLD. All information is believed to be accurate, but Randy L. Fridkis Auctions, LLC; (a) shall not be responsible for the correct description, authenticity, genuineness of, or any defect in, any item or lot; and (b) make no warranty in connection therewith. No allowances will be made or sale set aside on account of any incorrectness, error in cataloging or any other imperfection not noted. No deduction will be allowed for damaged articles as all goods being exposed for public exhibition are sold (I) "AS IS, WHERE IS, AND WITHOUT RECOURSE": and (ii) with no warranties, guarantees or representations of any kind or variety, whether expressed, written, implied or otherwise.

Your purchases are made in accordance with YOUR evaluation of the items(s) purchased and due diligence NOT our descriptions or representations. You assume all risks associated with bidding without inspection.

COMPLIANCE WITH THE TERMS OF SALE. If the Bidder fails to pay in full any amount owed in connection with a successful bid at the Auction within the designated time period, Randy L. Fridkis Auctions, LLC, in addition to all other remedies allowed by law, may retain all monies received as a deposit or otherwise liquidated damages. All items or lots not paid for within the time specified herein may be resold by Randy L. Fridkis Auctions, LLC at public or private sale without further notice. Any resulting deficiency, together with all expenses and costs of re-sale, will be the responsibility of the Bidder. The failure or default by the Bidder to comply fully with the terms and conditions herein will be treated as an immediate breach and any deposit or other payment that may have been made may be retained by Randy L. Fridkis Auctions, LLC and applied toward any deficit or additional costs or charges as incurred to effect the resale of that item or lot at private or public sale. There shall be no further notice required to the Bidder once a default has occurred. The Bidder shall be liable for all costs incurred, plus any deficit arising, from the Bidder's default.

PERSONAL AND PROPERTY RISK. Persons attending the sale or otherwise in attendance during the sale, exhibition, or removal of any item or lot assume all risks of damage of or loss to person and property and specifically release and indemnify Randy L. Fridkis Auctions, LLC from liability therefore. Neither Randy L. Fridkis Auctions, LLC the Seller nor any of their respective principals, officers, directors, employees or agents, shall be liable by reason of any defect in or condition of the premises in which the sale is held.

REMOVAL: Your purchases will be available for removal as indicated in the auction catalog or as announced at the auction. Small “hand carry-able” items can be removed by the buyer. Removal is the responsibility of the purchaser, no labor or equipment will be provided.

The successful bidder(s) shall be responsible for removal of all won lots in their entirety, they may not leave portions of their lots behind at the auction site.

RIGGING: A & A Machinery Movers is the exclusive rigger for this project.  A schedule of removal costs can be found at www.auctionsaleinfo.com

Companies or individuals disconnecting and / or moving equipment themselves from the site will be required to supply a certificate of liability insurance in an amount no less than Five Million Dollars per occurrence before they will be allowed to work and will be held to the same high standards as the preferred rigger.

Additional terms and conditions may be announced at the beginning of the auction. Announcements made at the Auction take precedence.

This is a Court Ordered sale and accordingly subject to approval by the Court. A hearing to approve the auction is scheduled for August 12th, but we cannot guarantee exactly when the Court will approve the sale.
