buyers premium of 18% in
addition to the hammer price
of each lot sold.
NO WARRANTIES:
Every item and lot in the
"Auction" is sold: (a) AS IS,
WHERE IS AND WITHOUT
RECOURSE", and (b) with no
warranties,
guarantees or representation
of any kind or variety,
whether
expressed, written, implied or
otherwise.
INSPECTION / REPRESENTATION:
If you choose to bid without
inspecting the items, your
bids
are in accordance with your
investigation and due
diligence
NOT our descriptions or
representations. You assume
all
risks associated with bidding
without inspection.
BALANCE OF PAYMENT:
If you are a successful online
or proxy bidder an invoice
will be EMAILED to you the
evening of the auction. The
balance indicated on the
invoice must be received via
wire
transfer by 12:00 NOON on THE
DAY AFTER THE AUCTION. In the
event this sum is NOT
received, your deposit may be
subject
to immediate forfeiture,
without recourse of any kind
and
the awarded item(s) sold to
another party.
REFUND:
In the event the Bidder is not
successful, the deposit
amount shall be returned via
the same method in which it
was
tendered within five business
days of the auction date.
ADDITION TO OR WITHDRAWAL FROM
SALE:
Continental Auction Group
reserves the right: (a) to
withdraw from the sale any
item or items; (b) to add and
sell any item or items not
listed; (c) to group one or
more
items or lots into one or more
selling lots; (d) to
subdivide any lots into two or
more selling lots; and (e) to
sell any/all of items listed
in bulk.
CONDITION OF ITEMS SOLD:
All information is believed to
be accurate, but Continental
Auction Group; (a) shall not
be responsible for the correct
description, authenticity,
genuineness of, or any defect
in,
any item or lot; and (b) make
no warranty in connection
therewith. No allowances will
be made or sale set aside on
account of any incorrectness,
error in cataloging or any
other imperfection not noted.
No deduction will be allowed
for damaged articles as all
goods being exposed for public
exhibition are sold (I) "AS
IS, WHERE IS, AND WITHOUT
RECOURSE": and (ii) with no
warranties, guarantees or
representations of any kind or
variety, whether expressed,
written, implied or otherwise.
Your purchases are made in
accordance with YOUR
evaluation of the items(s)
purchased.
COMPLIANCE WITH THE TERMS OF
SALE:
If the Bidder fails to pay in
full any amount owed in
connection with a successful
bid at the Auction within the
designated time period,
Continental Auction Group, in
addition to all other remedies
allowed by law, may retain
all monies received as a
deposit or otherwise
liquidated
damages. All items or lots not
paid for within the time
specified herein may be resold
by Continental Auction Group
at public or private sale
without further notice. Any
resulting deficiency, together
with all expenses and costs
of re-sale, will be the
responsibility of the Bidder.
The
failure or default by the
Bidder to comply fully with
the
terms and conditions herein
will be treated as an
immediate
breach and any deposit or
other payment that may have
been
made may be retained by
Continental Auction Group and
applied toward any deficit or
additional costs or charges as
incurred to effect the resale
of that item or lot at private
or public sale. There shall be
no further notice required to
the Bidder once a default has
occurred. The Bidder shall be
liable for all costs incurred,
plus any deficit arising,
from the Bidder's default.
PERSONAL AND PROPERTY RISK:
Persons attending the sale or
otherwise in attendance during
the sale, exhibition, or
removal of any item or lot
assume
all risks of damage of or loss
to person and property and
specifically release and
indemnify Continental Auction
Group
from liability therefore.
Neither Continental Auction
Group
the Seller nor any of their
respective principals,
officers,
directors, employees or
agents, shall be liable by
reason of
any defect in or condition of
the premises in which the sale
is held.
REMOVAL:
Your purchases will be
available as indicated in the
auction
catalog / terms of sale.
Removal is the sole
responsibility
of the purchaser.
The successful bidder(s) shall
be responsible for removal of
all won lots from the auction
site. Riggers, companies or
individuals disconnecting and
/ or moving equipment from the
site will be required to
supply a certificate of
liability
insurance in an amount no less
than One Million Dollars per
occurrence.
