Auctioneers Terms and Conditions
--- By making a bid, Bidder accepts the terms and conditions below and will be bound by them.
--- Auction Catalog is a guide-only. Ness Bros. reserves the right to group lots, reduce or add quantity to lots, add lots, or delete lots.
Announcements made the day of the sale take precedence over written or advertised announcements, but do not alter, in any way, the terms and conditions of the sale.
--- For online bidders, 18% will be applied to all purchases. Local Sales Tax may apply.
--- All Registered Bidders Placing Bids on Large Equipment and Vehicles are required to provide proof of funds with a bank statement emailed to onlineauctions@nessbros.com before end of auction.
--- All purchases must be paid in full the day of sale. After an item has been sold, it becomes the sole responsibility of the purchaser. Purchases will not be released until invoice is paid in full. All items must be removed by date specified for specific auction.
--- Acceptable forms of payment include Cash, Wire Transfer, Cashier’s Check, Personal or company check (ONLY IF accompanied by a Bank Letter of Guarantee.)
--- Ness Bros. makes every effort to accurately describe all items, but there is the possibility of error. Ness Bros. is not responsible for any errors or omissions in the description of merchandise.
--- Please inspect all items before bidding. Ness Bros. makes no warranty, expressed or implied. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor of items for sale. All sales are FINAL. All goods are sold “AS-IS” and “WHERE-IS”.
--- Bids are binding and cannot be withdrawn or altered once the auction has closed.
--- The Buyer shall be liable for any loss or damage caused by himself or his agents arising out of or in any way in connection with the performance of his contractual obligations (especially during pickup of the goods) and in this context shall indemnify Ness Bros. and its principals against all relevant third party claims including litigation costs. Unless excluded by law, the Buyer waives all rights to claim against Ness Bros. and Its principals In respect of any loss, damage or injury suffered by him, his personnel or his agents in connection With the take-over, collection or transportation of the goods and in this respect Ness Bros. and its principals shall also be indemnified against all claims from third parties.
--- The record of sales kept by the auctioneer and clerk will be taken as final.
---SPECIAL NOTE: Lot 10 John Deer 110 Tractor does not run, it starts but will not move forward or backwards.
---SPECIAL NOTE: Lot 19 Skid Steer with Forks and Bucket will be used to help load items on Removal Date and will not be available for Release to Winning Bidder until 4:00pm on May 30th.
