IDENTIFICATION: All buyers/purchasers are required to have a bidder's number to bid providing full name, address, phone number, photo and ID number.
CONDITIONS OF ITEMS SOLD: MDA shall not be responsible for the correct description, authenticity, genuineness of, or defect in any lot, and makes no warranty in connection therewith. No allowance will be made or item set aside due to any incorrectness error in cataloging, or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold “AS IS” and without recourse.
CLAIMS: No Claims will be allowed after removal of goods from premises.
DISPUTE BETWEEN BIDDERS: If any dispute arises between bidders it is up to the auctioneer’s sole discretion. Auctioneer’s decision is final.
RESERVE: The Auctioneer reserves the right to reject any and all bids. On lots upon which there is a reserve, the Auctioneer shall have the right to bid on behalf of the Seller.
RECORDS: The record of auction kept by the Auctioneer and bookkeeper will be taken as final in the event of any dispute.
ADDITION TO OR WITHDRAWAL FROM AUCTION: The auctioneer reserves the right to withdraw from auction any of the items listed or to sell at this auction items not listed, and also reserves the right to group one or more lots into one or more selling lots or to subdivide into two or more selling lots. Whenever the best interest of the seller will be served, the auctioneer reserves the right to sell all of the items listed in any manner he chooses.
TIME & PAYMENT: All invoices must be paid in full by the auctions conclusion. Any other arrangements must be made with Auctioneer prior to bidding. If not, the merchandise will be deemed abandoned and Buyer will loose any right, title or interest Buyer may have acquired and the merchandise shall revert to Auctioneer without further notice to Buyer and the transaction shall be null and void as to Buyer. Winning bid must be paid by cash, check (with bank letter of credit), master card, visa or wire transfer. No items will be released until funds have cleared MDA account.
CLAIMS: All items are sold on an “as is” and “where-is” basis with absolutely no warranty of any kind, including merchantability and/or fitness for a particular purpose. No claims will be allowed after goods are removed from premises.
RISK TO PERSON AND PROPERTY: Persons attending during exhibition, auction or removal of goods assume all risks of damage of or loss to person and property and specifically release Auctioneer from liability therefor. Neither the Auctioneer nor his principal shall be liable by reason or any defect in or condition of the premises on which the auction is held.
NON-DELIVERY RESPONSIBILITY: Auctioneer shall not, in any event, be liable for non-delivery or for any other matter or thing, to any purchaser of any lot.
REMOVAL: All purchases must be removed not later that the date specified in the auction Catalog and/or announced at the auction time. No lot can, on any account, be removed during the auction. All goods are sold “Where Is”. Removal shall be at the expense, liability, and risk of the buyer. Purchases will be delivered only on presentation of paid bill. Auctioneer shall not be responsible for goods not removed, and shall have the option of removing, storing or disposing at the expense and risk of the buyer any article purchased, or not paid for and removed within the specified time.
INSURANCE: All Buyers, or the Buyer's riggers, must provide the Auctioneer, Owner and Landlord a certificate of insurance in amounts acceptable to the above parties prior to removal of any machinery and equipment.
AGENCY: The auctioneer is acting as agent only and is not responsible for acts of its principals.
ADDITIONAL TERMS AND CONDITIONS: The Auctionee may modifiy or supplement these terms and conditions of auction by language in the catalog available at the auction site or by announcement at the start of the auction.
CURRENCY TYPE: CASH (USD), GOOD CHECK (WITH BANK LETTER OF CREDIT REQUIRED FOR PURCHASES), MASTER CARD/VISA, WIRE TRANSFERS (WITH LETTER OF GUARANTEE) AT EARLIEST BANK DAY. ANY RETURNED CHECK FOR ANY REASON WILL BE ASSESSED A $50.00 FEE.
TERMS OF SALE: All bidders and others attending this auction agree that they have read and fully understand these terms and agree to be bound by them. All terms and conditions and other announcements made the day of the auction are binding and take precedence over any information found herein.
