Terms and Conditions

TERMS & CONDITIONS

1. By registering and accepting a Bid Number, you are
consenting to these Terms and Conditions set forth by Mack
Auction Company Ltd. and those of Bidspotter.com;
2. All buyers must register at each sale.
3. A current letter of credit from your financial
institution must be faxed or e-mailed to Mack Auction
Company no later than 48 hours prior to the auction in which
you wish to participate in. It must be current and made in
favour of Mack Auction Company and it must specify the
maximum amount of your credit. Fax # is (306) 636 -2173
4. Payment must be made in Canadian funds. Payments
accepted are cash, certified cheque or wire transfer. Full
payment must be made within one banking day of receipt of
invoice. Full payment is required prior to removal of items
purchased.
5. G.S.T. and P.S.T. will be charged in addition to
amount of accepted bid where applicable;
6. N.S.F. Cheques will not be tolerated. Anyone
issuing a NSF cheque are subject to criminal charges and
will be responsible for any financial loses to Mack Auction
Company;
7. Bidder acquires title upon Payment in Full;
8. Purchased items shall be removed immediately on
payment of same;
9. Highest bid accepted by the Auctioneer shall be the
buyer. If dispute between bidders, the Auctioneer may, at
his discretion determine successful bidder or may re-offer
the lot;
10. All sales final unless item is real property in
which event Purchaser and Vendor must sign an agreement of
sale in which event written sale terms apply. No bidder
shall retract a bid made and accepted;
11. Mack Auction Company Ltd. does not guarantee the
ownership, year, hours, conditions, description,
authenticity, suitability or status of title of any item or
lot. It is your responsibility to fully and thoroughly
inspect each item. No statement made shall be interpreted
verbal or written warranty or representation;
12. All items sell ?as is?, ?where is? and are at the
risk of buyer once the Auctioneer has declared the item
sold, all sales are final and binding;
13. If the Auctioneer decides that any opening bid is
too low, he may reject it. The Auctioneer reserves the
right to withdraw any lot from the sale or to divide any
lot, or to combine any two or more lots at his sole
discretion;
14. Announcements by the Auctioneer on sale day will
take precedence over printed material;
15. Mack Auction Company is providing internet on-line
bidding as a service to bidders. Bidders acknowledge and
understands that this service may or may not function
correctly the day of the auction. Under no circumstances
shall the bidder have any kind of claim against Mack Auction
Company or anyone else if the internet service fails to work
correctly before or during the live auction. Mack Auction
Company will not be responsible for any missed bids from any
source.
16. A buyer?s premium will apply to Bidspotter.com
purchases. 3.0% (UP TO A MAXIMUM OF $600.00) will be applied per item purchased online.
17. Mack Auction Company Ltd. will not be held responsible
for any person or persons injured at the sale. By
registering, the signor releases Mack Auction Company Ltd.
from all or any legal or financial encumbrances.
