- Your invoice must be authorized and marked ‘PAID’ at the on-site auction office and be verified by a Long Drive Inc. representative before any equipment/items can be removed.
- Coordinating the removal of all items purchased and all associated costs are solely the responsibility of the Buyer.
**As a Buyer you are responsible for the following at your expense:
1. All electrical, gas, water and/or air lines to machines must be disconnected/terminated properly and safely. You must adhere to all governing building codes;
2. Any/all fasteners or anchor bolts must be left flush with the floor;
3. Until repaired, safety barriers must be erected around any pits/holes in the floor caused by the removal of your purchased items/equipment;
4. Any/all holes in the floor, walls or roof caused by the removal of your purchased items/equipment must be repaired. You must adhere to all governing building codes;
5. All machine oils, all hazardous materials and/or all contaminants contained in your purchased items are to be removed off premises;
6. You are solely responsible for repairs of any/all damage caused to the premises by yourself, your staff or any other third party hired by you for the removal of your purchased items;
7. Work area must be left clean and in ‘broom swept’ condition upon the completion of work;
8. Further terms and conditions may be communicated to you by a Long Drive Inc. representative prior to, during or after the sale as they arise;
9. You must adhere to the removal deadline (time/date) communicated to you by Long Drive Inc. pertaining to the sale you purchased from; and
10. You are responsible for the safety of all/any of your employees, representatives or any movers/riggers hired by you to move/remove your purchased items.
· Before removal is permitted, the Buyer and/or any movers or riggers hired by said Buyer must have valid insurance coverage and workers compensation certificates (at least $5,000,000 in comprehensive liability insurance coverage incl. workers compensation and auto). Coverage must be per person, per occurrence. These documents must be sent to Long Drive Inc. prior to removal or presented to the site supervisor upon arrival to the auction site.
- Before any items are removed from the site they must be verified by a Long Drive Inc. representative. They will verify with a signature, as will the Buyer. This confirms your receipt of items on the invoice.
- Removal hours are typically weekdays between 8:00 a.m. and 4:00 p.m., unless otherwise specified or pre-arranged with the site supervisor. No items can be removed until the auction is complete.
- In the case of any damages to the premises or other assets caused by any employee or representative of any Buyer and/or their riggers/movers, be it due to negligence or other, the Buyer and rigger/mover will be held jointly and severally liable for all costs and expenses. Should any expenses or claims be incurred by Long Drive Inc. due to, or as a result of, any actions or omissions by said Buyer and/or rigger/mover hired or retained by such Buyer, the Buyer indemnifies and saves Long Drive Inc. from all claims or expenses incurred.
ONLY WHEN THE ABOVE HAS BEEN ADHERED TO AT THE SATISFACTION OF LONG DRIVE INC. WILL ITEMS BE APPROVED FOR REMOVAL FROM THE PREMISES.
BUYERS:
Please remember that as a Buyer you will be held liable for the conduct of any person/s or companies hired by you on site, including but not limited to movers and riggers.
With this in mind, we require you to provide them with a copy of the above terms, conditions, and procedures.

1. The auction catalogue is simply a guide for buyers. The Auctioneer (Long Drive Inc) believes the catalogue descriptions to be correct, but give no warranty or guarantee based on said descriptions.
2. All lots are subject to prior sale. In addition, the Auctioneer reserves the right to reserve and bid for the account of others or their own by proxy, either written or verbal.
3. Long Drive Inc. reserves the right to refuse any person/s the privilege to bid or attend any auction in any capacity. We also may revoke any person/s bidding privileges at any time.
4. A pre-authorized deposit is required to participate in any auction. Deposits range from $500-$1000. The exact amount will be posted for each individual sale and are held for the duration of the auction. A deposit is required so the Auctioneer can be rest assured that the buyer will honour their auction purchase. Failure to honour your purchase will result in your deposit not being returned and the purchases becoming property of the Auctioneer to re-sell via auction or private sale, or however they see fit, at no further recourse.
5. In conforming to the bid process, at the Auctioneers discretion, all lots will be sold to the highest bidder, provided the lots are sold as individual, group lots or in bulk. The Auctioneer may sell on behalf of third parties, their own account or the account of others. Any dispute that arises between two or more bidders regarding any lot or bid in question is to be resolved by the Auctioneer. He may immediately resell the item if he sees fit. The Auctioneer has the final decision on all aspects of the sale and will make a final decision on any disputes as he sees fit. The 'clerking sheets' will be accepted as final by the buyer in any dispute.
6. Title of any lots purchased will not be passed/transfered to the buyer until their invoiced purchase price has been recieved in full by Long Drive Inc. All lots sold are finalized by the Auctioneer. Once concluded by the Auctioneer, no buyer can retract their bid.
7. ALL SALES ARE FINAL. NO SALE SHALL BE INVALIDATED, AND THE AUCTIONEER SHALL HAVE NO LIABILITY FOR A MISDESCRIPTION OF ANY ARTICLE OR LOT WHETHER CONTAINED IN A CATALOGUE, ADVERTISEMENT OR OTHERWISE. ALL ITEMS ARE SOLD "AS IS, WHERE IS" ("IN PLACE", "WITH ALL FAULTS"). WE OFFER NO WARRANTIES OF CONDITIONS WHETHER EXPRESSED OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO CONDITIONS OR WARRANTIES TO TITLE, DESCRIPTION, MERCHANTABILITY, QUALITY, QUANTITY, FITNESS FOR PURPOSE, LOCATION, CONDITION, STATE OR OTHERWISE. 8. All items must be removed by the buyer and all terms/conditions and guidelines must be adhered to. No items can be removed until payment has been received in full. Buyers are fully responsible for all removal costs and will be held fully liable for any/all damages caused as a result of this removal, including, without limitation, any environmental damage caused. Buyers must comply with all environmental laws and regulations, including requirements to bond movers if deemed necessary. No claims will be allowed after removal of items/purchases.
9. Any documents of transfer that are in the possession of the Auctioneer (ie. vehicle ownership) will be provided to the buyer upon completion of the auction. If not readily available, the documents will be provided to the buyer as soon as said documents are made available.
10. Long Drive Inc. shall not be liable if, for any reason, the websites are unavailable at any time or for any period. On rare occasions, website access may be suspended temporarily and without notice in the case of system failure, maintenance, repair or other factors beyond the control of Long Drive Inc. If an issue of this nature occurs, we reserve the right to re-list or adjust bidding periods on effected auction.
11. Buyer is not permitted to transfer, reassign or remove their rights for any article purchased unless the purchase price has been paid in full by said buyer.
12. Buyers must pay all provincial and federal taxes at time of purchase. If exempt, buyer must provide exemption certificates at time of payment. All auction purchases are subject to H.S.T. (Federal Harmonized Sales Tax) following the buyers premium. No exceptions will be made.
13. Time is of utmost importance. If the buyer fails to provide payment in full or fails to remove their purchased goods within the terms and time frames provided to them by the Auctioneer, this invoice will be deemed abandoned. The Auctioneer reserves the right to resell the purchased item/s. We may resell by auction, private sale or otherwise at our own discretion. The buyer will be held liable for any monetary mitigation deficiency and costs as a result their failure to adhere to the outlined terms and timelines, including all removal, rent, layover and hold over fees, such as daily penalties per lot, until items can be removed and any other fees or costs associated with loss to Auctioneer.
14. Title passes at the time of payment in full. Once title has passed, the Auctioneer assumes no responsibility for any liability. We advise that all buyers prearrange appropriate insurance coverage for their purchases. If for any reason the buyer does not remove their purchases within the time specified, the title will revert to the seller.
15. If the Auctioneer, for any unforeseen circumstances, such as fire, theft or any other reason, is not able to deliver on a purchase to the buyer, the Auctioneer will reimburse the buyer all monies paid to the Auctioneer for this purchase. The Auctioneer assumes no further liability to the buyer relating to or arising from this purchase, including but not limited to any loss of profits or damages.
16. Buyers acknowledge and are aware that an auction site is a potentially dangerous place. Noxious, pressurized and corrosive substances and materials may be present. Electric circuits may be live and heavy machinery may be in use at any given time. Any person/s entering the auction site before, during or after the day of sale are deemed to be there at their own risk and are fully aware of the condition of the premises, all activities taking place on the premises and the conduct of third parties. It is the buyers responsibility to advise all their agents and/or employees of the aforementioned. No claims shall be made against the Auctioneer, his agents, employees or principles for damages to or loss of property, or for any injuries sustained from any cause whatsoever.
17. All buyers acknowledge that they have received, read and fully understand Terms 1 through 16 and agree to comply and be bound by such Terms.
