No assets shall be removed unless paid for in full.  The buyer shall be responsible for all costs of removal and shall be liable for any damage caused during or as a result of the removal.  Purchasers shall comply with all environmental laws and regulations and all requirements established by the auctioneer for the removal of articles.

The auctioneer and its partners cannot be held liable for issues or damages sustained during loading or transport. All third party vendors and contractors carry their own insurance policies

Buyer's Premium: 18% Buyer's Premium applies on all online purchases and applicable taxes. 

Payments: All successful bidders can pay by credit card (3% fee applied to Mastercard & Visa, 5% Amex and Discover), check (certified preferred or personal with bank letter), or wire transfer. All successful bidders will receive their invoices via email from Liberty Machine Works by end of day June 5 2024. Payments are to be made in full within 24 hours of the auction close. Payments not received may be canceled and reported for nonpayment.

Taxes: All successful bidders will be responsible for sales taxes which will be added to your invoice unless an exemption certificate is supplied prior to invoicing.

Refunds: No refunds or adjustments will be made once an item has been removed from the auction site. All refunds and adjustments are solely at the discretion of the auction company.

 All purchases are required to have a Buyer's number.  The Buyer number will be valid for this Auction only and may be received in the Auction office. 

 When items are to be sold by estimated count, measure, or weight the purchaser will be billed for and required to pay for the estimated count, measure, or weight.  If any shortage exists at the time of removal, the Buyer will receive a refund at the rate of purchase.  If there is an excess, the purchaser will be required to accept and pay for this excess, at the rate of purchase.  Liberty Machine Works reserves the right to reject any bids.  On lots that have a reserve, Liberty Machine Works shall have the right to bid on behalf of the Seller. Liberty Machine Works shall not be responsible for the correct description, authenticity, genuineness of, or defect in any lot and makes no warranties, expressed or implied.  No allowance will be made, or sales will be set aside on account of any incorrectness or errors in cataloging or any imperfections not noted.  No deductions will be allowed on damaged articles, as all goods are being sold “AS IS”, with no warranty, expressed or implied.   

Lots are subject to cancellation and withdrawal from the auction without prior notice.  Liberty Machine Works reserves the right to augment this auction with lots from additional sellers. These additional lots may be interspersed and not specifically identified throughout the auction.  Liberty Machine Works reserves the right to group, regroup, reduce, add to or delete lots.

Everything will be sold to the highest bidders for cash, in accordance with Liberty Machine Works’’ normal Terms of Sale.  Your bid is a contract: Place a bid only if you are serious about buying the item. If you are the high bidder, you will enter into a legally binding agreement with Liberty Machine Works.  The bids are in US dollars. An 18% Buyers Premium will be added to all items sold.  Liberty Machine Works makes every attempt to accurately describe all items at the auction sale, there are always possibilities of errors occurring which are out of Liberty Machine Works control. It is important to know this fact if you plan on placing a Proxy Bid or if you plan on bidding over the WEB.


Please inspect before you bid and remember, everything is sold AS IS, with absolutely no warranty or guarantee of any kind, either written or implied. 

Immediately upon lot closing, the bidder shall be the purchaser of the lots and thereafter the lots shall become the sole and absolute responsibility of the bidder.  Bidder shall thereupon and thereafter assume all risk of loss (including but not limited to loss by way of theft or damage) and liability relating to the lots.  Bidders are advised to pre-arrange insurance coverage for bidders purchases as there will be no refunds for missing, lost, damaged or stolen lots. 

BIDDER HEREBY ACKNOWLEDGES AND AGREES THAT NEITHER LIBERTY MACHINE WORKS OR EMPLOYEES  SHALL BE LIABLE FOR SPECIAL, CONSEQUENTIAL, OR INCIDENTAL DAMAGES.

Title to and possession of lots shall not pass to the bidder until Liberty Machine Works has received payment in full for all lots purchased by the bidder. All lots and the entirety of bidder’s invoice require payment in full prior to Liberty Machine Works releasing any lots. If all lots are not paid in full by bidder for any reason, Liberty Machine Works will retain all lots and any and all monetary consideration paid by bidder to mitigate Liberty Machine Works financial damages caused by bidder. If after the subsequent mitigation amounts (if any) received by Liberty Machine Works exceed the amount of the bidder's invoice and costs incurred by Liberty Machine Works fees, Liberty Machine Works will refund such amounts to the bidder once determined by Liberty Machine Works sole discretion. Bidder hereby agrees lots purchased at this auction will be invoiced in totality, although in some cases separately priced on the invoice, the total amount due Liberty Machine Works of bidder’s invoice is deemed a single agreement in the event of a legal dispute.     

If for any reason bidder fails to pay the full amount of bidder’s invoice within the first banking day (24 hours after the auction), and/or fails to remove all of bidders lots on or before the date posted on bidder’s  invoice, and/or fails to comply with any other terms and conditions of this agreement, all lots on the bidder’s invoice will be considered abandoned and at Liberty Machine Works sole discretion and without further notice to bidder may remove, dispose of, scrap, resell at public or private sale, any or all lots . Bidder agrees to pay Liberty Machine Works, as applicable, any monetary mitigation deficiency and costs as a result thereof, including all removal, rent, lay and hold over fees, and any other fees or costs associated with Liberty Machine Works loss.  Bidder understands and acknowledges that there is sufficient consideration by both parties to perform, and that if payment in full is not made within the specific time outlined in this agreement, bidder agrees to be bound by a “consent judgment” and is in violation and in default of this agreement. By bidding, bidder consents to the terms of a judgment entered against bidder and hereby waives bidders rights to any court proceeding. In addition, relating to such disposition of lots, together with all charges, including attorney’s fees, arbitration fees, interest and any and all other expenses in connection with such disposition, plus a $400.00 per diem administrative fee per lot until such lots are removed. Bidder agrees that “time is of the essence” in regards to agreement, regarding payment of bidder’s invoice and removal of bidder’s lots.

Liberty Machine Works may provide contact information for riggers, machinery movers or other service providers. Liberty Machine Works is not affiliated with, nor shall be responsible or liable for the action of, any rigger, machinery mover or other service provider utilized by a bidder or bidders authorized representative. Liberty Machine Works may require the use of one or more specific riggers, machinery movers or other service providers at the premises at which lots are located. Such a requirement does not constitute a guarantee or endorsement by Liberty Machine Works

All electrical disconnect, liquid removal, rigging, loading, broom cleaning, trash & debris removal, floor stud removal and transportation are the sole and absolute responsibility of the bidder. Bidder agrees to remove all of the bidder's purchased lots in full, with no abandonment privileges from the premises on or before the date on the bidder’s invoice.

No lots, no matter how small, may be removed while the auction is in progress. 

It is the bidder's responsibility to secure all safety equipment to meet all applicable government safety standards in using or removing any lots  purchased. Certain lots may contain residual chemicals and/or hazardous materials. Bidder hereby agrees to indemnify and hold harmless Liberty Machine Works, Owner, and any mortgagee, property manager, and their respective officers, directors, employees, affiliates, successors and assigns from any and all damages, claims, liabilities from any injuries to persons, or damage to property of any type whatsoever caused by bidder, its agents, employees, or contractors during the sale, during the removal, use, or operation of the lots purchased. Any hydraulic fluid removal and/or oil leaks are the bidder's responsibility to remove and clean up. Bidder takes full responsibility for compliance with all applicable Federal, State, and Local environmental laws, statutes, regulations, rules, and/or ordinances and shall exercise reasonable care to ensure that there is no release to the environment of any hazardous wastes or substances as defined in applicable Federal, State, and Local laws, statues, regulations, rules, and/or ordinances.

Liberty Machine Works is not liable for bidder’s personal belongings left on premises.

Any surface or structural damage to the premises including but not limited to the walls, ceilings, floors, overhead doors, gates and/or any other item(s), etc. are the bidder’s sole responsibility. Bidders will not be permitted to leave with lots until all repairs are made to the premises.
