Auctioneers Terms and Conditions

By making a bid, Bidder accepts the terms and conditions below and will be bound by them.

The following information is for general reference only. Terms may vary from sale to sale. Bidders should always review the sale details for specific information. Industrial Bay International Auctions referred to herein as IBIA.

IBIA makes every effort to accurately describe all items, but there is the possibility of error. IBIA is not respondible for any errors or omissions in the description of merchandise.   The auctioneer reserves the right to reject any and all bids. On lots upon which there is a reserve, the auctioneer or his assigned agents, shall have the right to bid on behalf of the seller. 

The record of sales kept by the auctioneer and clerk will be taken as final.

Removal - Buyers are responsible for removing all purchased lots from site by removal deadline as specified. All items become the sole responsibility of the purchaser upon final bid acceptance. All lots purchased shall be removed in their entirety at the buyers sole cost and responsibility and by the date as specified. Buyers with items left on site after deadline are subject to fines of $75 per day or could be subject to abandonment with no further recourse.

Removal shall be at the expense, liability, and risk of the purchaser. Purchases will be released only on presentation of paid bill. IBIA shall not be responsible for goods not removed within the time specified, and shall have the option of removing and storing or reselling at the expense and risk of the purchaser any article purchased. 

There will be NO removal allowed the day of the sale.

To Release - A buyers release in the form of IBIA issued receipt of payment must be supplied to IBIA personnel at the time registered bidder or authorized representative is picking up auction purchases.

Goods will not be released until payment has been received in full. Wire transfers (this may take up to 48 hours) and credit card transactions (plug n pay directly on auction site) must clear in order for payment to be considered received in full.  Payments made at time of pick up must be exchanged over to CAD and credit card or CA debit card transaction completed on site, no goods will be released until authorization received. Pre-approval needed. 

Conditions - All property is sold "AS IS, WHERE IS". IBIA and its consignors, agents, employees, directors or principals do not make any representation or warranty, oral or written, expressed or implied, as to the merchantability, fitness for a particular purpose, condition of the property, correctness of the description, condition, capacity, age or any other details used to describe the property. 

Bidding is on items listed in the lot descriptions and not all items shown in the photographs.

Items purchased may not incorporate approved activating mechanisms, operating safety devices or safety guards, as required by OSHA, CCOHS or otherwise. It purchaser`s responsibility that articles purchased be so equipped and safeguarded to meet OSHA and any other requirements before placing such articles into operation. 

Absolutely NO RETURN of sold goods, NO REFUNDS, and NO EXCHANGES will be permitted.

Indemnification - Buyer shall defend and indemnify and hold auctioneer and seller harmless from and against all claims and liabilities relating to the condition of, removal of, or use of the articles purchased or failure of user to follow instructions, warnings or recommendations of the manufacturer, or to comply with federal, state or provincial, and local laws applicable to such articles, including OSHA requirements, and Environmental Protection Agency requirements, or for proximate or consequential damages, costs or legal expenses arising there from.
