TERMS & CONDITIONS: For Webster Machining Corp. 10/9/13
1. No merchandise may be removed until complete settlement
has been made.
2. All purchases shall be paid for "in full" on day of sale.
3. Purchases shall be paid for with cash ,check. or wire
transfer. Invoices up to $10,000 may be
paid with company check. Invoices above $10,000 MUST be paid
by Wire Transfer. Credit cards are
NOT accepted.
4. All items are sold "as is", "where is" and "how is" with
no warranties of any type expressed or
implied concerning the merchandise being sold.
5. Descriptions of merchandise contained in the catalog are
intended for general information
purposes only. Please examine items carefully before
bidding, as no refunds will be given.
6. A Buyer`s Premium of 10% in house or 13% online applies
to all items.
7. No one under 18 years of age is permitted to register or
bid.
8. After an item has been sold, it becomes the sole
responsibility of the purchaser. All risk of
loss passes to the buyer upon the declaration that the item
has been sold. Any item purchased must
be removed in its entirety.
9. An invoice will be supplied to the purchaser at the time
of settlement. This invoice, properly
authenticated by our cashier, will be required by our check
out personnel in order that you may
remove the purchased items.
10. The auctioneer may remove items from the sale at his
discretion.
11. The auctioneer is the sole authority on any disputed
bid, and his word is final. We reserve the
right to correct any clerical errors and to re-invoice if
necessary.
12. If a dispute arises out of this contract that cannot be
settled through negotiation, the parties
agree first to try in good faith to settle the dispute by
mediation before resorting to arbitration,
litigation, or some other dispute resolution procedure. Any
and all court proceedings resulting from a
dispute are to take place in Butler, PA.
13.Real Estate is sold by reserve and owner conformation.
14. All machines are either disconnected at the plug or at
the quick disconnect box, box not
included.
REMOVAL DATES & TIMES;
Weekdays 8:00 A.M. to 4:00 P.M. , no Saturdays or Sundays .
Items are to be removed by 10/16/13.
Late removal by appointment only , a fee of $150.00 per day
will be charged per appointment day.
Final removal no later than 10/29/13. Any items left after
10/29/13 will be considered abandoned.
NOTES:
* Fork trucks are sold with propane tanks. Lot # 904,
Mitsubishi air tired fork truck is reserved
untill 10/16/13 at noon. The fork truck is to be used by the
auction staff or employees of Webster
Machining Corp.only.
* Any person or company choosing to use their own equipment
to remove items must sign a
waiver of liability and provide proof of $1 million
liability insurance.
* Hartland Machinery Auctioneers do NOT provide storing,
packing, loading or transporting
services.
Your signature on the Terms Signature page indicates your
agreement to the terms of sale and
agreement to hold Hartland Machinery Auctioneers, its owners
and employees, in addition to the
owners, employees and landlord of the party or parties
commissioning Hartland Machinery
Auctioneers, harmless from any and all injury or loss.
