#1. You are attending this auction at your own risk. Neither the auctioneer nor seller(s) assume responsibility while on the premises.
#2. You must have a bidder’s number to bid on any item. The auctioneer reserves the right to refuse to register anyone without a reason.
#3. This list is provided for your convenience and mistakes in typing do occur. This catalog is meant merely as a guide. It is up to you, the buyer,
during the specified time to determine all aspects and condition of the item you are bidding on, all items are sold as is, where is.
NO GUARANTEE or WARRANTY is expressed or implied. ABSOLUTELY NO REFUNDS OR EXCHANGES WILL BE GIVEN.
#4. Do not attempt to move any item without a paid invoice and one of our personnel to assist you.
#5. All items must be paid for one hour immediately following the sale. If a buyer fails to make payment in full immediately following the sale
the auctioneer may, at his discretion, resale such property at public or private sale and buyer shall be required to pay any loss of expenses
incurred therein, including attorney fees and court cost, chapter 2 of the Texas Business and Commerce Code.
#6. Payment: CASH OR CHECKS with bank letter of guarantee made out to Bradshaw Auctions for this sale indicating the amount of check
guarantee. THE AUCTIONEERS RESERVE THE RIGHT TO REFUSE A CHECK FROM ANYONE WITHOUT REASON.
Any Check over $500.00 will have to be verified on Monday before you may take any Equipment. (Unless you have a bank letter of credit
or it is approved by Charlie.) If you cannot comply with these payment Terms, please refrain from bidding.
#7. This auction is subject to Sales Tax Laws of this State, if not tax exempt!
#8. Any bidder buying for resale must have their 11-digit Texas Sales Tax Number and Exemption application filled out and in our file prior to the
start of this auction. To receive a sales tax exemption for your purchase, you will need to provide your Agriculture Registration Number.
NO EXCEPTIONS! Tax will be added to all purchases without this number.
BUYERS MUST SIGN ALL COPIES WHEN PAYING OUT!!!!
#9. The auctioneer is in full control of the auction and reserves the right to settle any dispute between bidders.
Bid increments are at the discretion of the auctioneer.
#10. THERE IS A BASE BUYERS PREMIUM OF 5% ADDED TO THE HAMMER PRICE FOR EACH ITEM PURCHASED THAT IS CAPPED AT $1000.00. IF YOU PUCHASE AN ITEM ON THE INTERNET THERE IS AN ADDITIONAL 3% BUYERS PREMIUM WITHOUT A CAP LIMIT THAT WILL BE ADDED TO THE BASE BUYERS PREMIUM. ONSITE AND INTERNET PURCHASES PAID FOR WITH A METHOD OTHER THAN CASH, CHECK, CASHIERS CHECK, TRAVELERS CHECK, OR MONEY ORDER WILL BE SUBJECT TO AN ADDITIONAL 3% BUYERS PREMIUM. ATTENTION BUYER VEIW THIS!
EXAMPLE--- If you are a cash customer and bid $100.00 for an item ONSITE your total will be $105.00. Example—INTERNET BUYER PAYING CASH your total will be $108.00 for that same $100.00 purchase.
#11. Deadline for removal is Friday, November 20th, 2015 by 5:00 p.m. Items both purchased and not sold must be removed.

#12. All items are sold times the quantity unless announced by the auctioneer.
#13. Personnel working this auction cannot load items until they have a paid receipt in hand.
#14. This auctioneer is licensed and regulated under state issued recovery fund. This fund protects both the buyer and seller from an inappropriate
and fraudulent action by the auctioneer. This auctioneer license# is 11684. Information concerning this recovery fund of these auctioneers

#16. This auction is being electronically and manually recorded.
#17. Tie Bids: open between last two bidders.
#18. Vehicle Titles: Document fee is $50.00, unless you are a dealer.
#19. We keep control of all keys until the item is paid for.
#20. You must see the title lady on the day of the sale about TT&L on titles. Titles will be mailed out in two weeks!!! Taxes and Fees will be
due and collected on all vehicles purchased.
#21. To make payouts faster, please write down the lot numbers of the items you buy. Thank You.
#22. We are definitely not responsible for theft, accidents, fire, or year models, and mileage!
#23. New Wire Transfer Procedure: Any Wire Transfers must be completed and funds transferred in full by
Monday November 16th, 2015 Partial wires WILL NOT BE accepted.
#24. Loading of Equipment will begin on Saturday from 10AM till dark and Sunday 1PM till 5PM for this auction. Loading is free on the
day of auction only. As a rule, if our forklift can’t lift the item you purchased, then we can’t load the item.
REMEMBER to send buyers invoice (receipt) with your drivers.
#25. Due to non-payment on a Proxy bid, anyone wishing to leave a proxy bid on any item must leave a deposit. If you do not win that item, we
will fully refund your deposit.
#26. In case of buyer default, the item in question will revert back to its original owner.
