All assets being sold at the former New Buffalo Print Factory will be sold in their “as-is” “where-is” condition.  Auctions International, Inc and the Seller makes no express or implied warranties beyond the face hereof, including, but not limited to, for “Merchantability” OR “Fitness for a particular purpose”.

All bidders are strongly urged to inspect items prior to bidding.

All bidders must register before bidding upon any item being auctioned. Bidder numbers, at the live sale, may be obtained from 8:00AM (EST) on the day of the auction until the last item has been sold. Bidders must provide a sufficient means of identification at the time of registration; a valid driver’s license will suffice. Bidders are responsible for ALL bids on their assigned number.

The Seller and Auctions International, Inc shall not be liable for any incidental or consequential damages.

Full payment MUST be made immediately following the sale by credit card, cash, bank check or money order payable to Auctions International, Inc.

No assets may be started, moved or worked on until the completion of the auction. No loading assistance will be available.

The Seller and Auctions International, Inc. is not responsible for damage to auctioned items. It is advised that purchased items be removed immediately.

All items MUST be removed by Wednesday, October 28^th by 4:00PM EST. All items left at the facility after this time will be considered abandoned and will be disposed of accordingly.  High bidder may be liable for disposal costs.  This facility must be completely emptied and broom swept by the month’s end, so these removal terms will be strictly enforced. There will be NO shipping available. Removal is entirely up to the successful high bidder(s).

BID RIGGING IS A FELONY!  Agreements among buyers at auctions not to bid against each other for the purpose of purchasing goods at low and non-competitive prices can be a criminal violation of the Federal Antitrust Laws, punishable by heavy fines and imprisonment.  The Sherman Act prohibits bid rigging agreements among competitors if they affect or restrain interstate commerce.  Upon conviction, individuals are subject to a maximum fine of $100,000.00, and/or Three year imprisonment.  Corporations are subject to a maximum fine of one million dollars.

This sale is subject to additions, deletions, and omissions.

PAYMENT TERMS

Live Bidder Payment Terms:

There will be a 12% Buyer’s Premium in effect for this auction. 12% Buyer’s Premium to be charged to the purchaser with a $1.00 minimum auction receipt requirement. If purchaser pays Auctions International, Inc. by credit card a 4% credit card convenience fee will be charged. Such charge will be in addition to the 12% Buyer’s Premium charged to the purchaser. Auctions International, Inc. will accept only the following forms of payment for this auction:

-Cash

-Bank Check or Money Order (CERTIFIED FUNDS)

-All Major Credit Cards (Discover, VISA, MasterCard, American Express (AmEx)

ONLINE BIDDERS (BidSpotter.com) Payment Terms:

Successful high bidders, who bid online, through BidSpotter.com, will be required to pay with a credit card immediately upon winning a lot. You MUST be available via the phone number you registered with. Auctions International, Inc. staff will be calling you immediately after you win a lot.  Failure to answer the phone may result in your high bid being revoked and immediate removal from the remainder of the auction.  If you wish to continue bidding on this auction, you must provide our staff with your credit card information and we will hold it until the auction is over, processing your purchases upon conclusion of the sale.

Taxation:

Erie County sales tax will be charged at this auction as per the NYS Finance and Taxation department. The Erie County tax rate is 8.75%.  If you are tax exempt, this tax rate can/will be removed with proper documentation completed in its totality. (NYS Farm Exempt Form: ST125, NYS RESALE CERTIFICATE: ST120) 

REMOVAL TERMS:

-Purchasers of the pallet racking (Lot #’s 277-292) and/or pallet racking that is taller than 6 feet,  will need to have a Certificate of Insurance naming Auctions International, Inc and Gildan as additional insured for an amount of $1 million (one million dollars USD) 

-Any powered equipment (man lift, forklift ect.) brought into the auction facility will need to provide a Certificate of Insurance naming Auctions International and Gildan as additional insured for an amount of $1 million (one million dollars USD) [DISCLAIMER; Your equipment will not be allowed in the facility without proof of insurance in the hands of Auctions International, Inc. staff.

-All items MUST be removed by Wednesday, October 28^th by 4:00PM EST. NO EXCEPTION!

 All items left at the facility after this time will be considered abandoned and will be disposed of accordingly

REMOVAL WILL BE UNTIL 7PM the day of sale.
