1. IDENTIFICATION: All bidders must register to be pre-approved. Registrants must provide the following information: full name; valid phone number; valid street address; valid driver?s license/state photo ID; valid Visa or Mastercard credit card.

2. DEPOSITS: For bidders in the United States, no deposit will be required.

For INTERNATIONAL BIDDERS, a refundable deposit of $500 must be submitted for bidder approval. This deposit will be refunded as arranged by bidder and AAA Auction Service, Inc.

3. BUYER?S PREMIUM: A buyer?s premium of 16% will be applied to all invoices.

4. PAYMENT: An invoice will be emailed to all winning bidders within 24 hours of the auction completion. For amounts less than $1,000, your credit card will be charged immediately. For amounts greater than $1,000, your credit card will be charged $1,000 immediately, and the remaining balance will be due within 48 hours of auction completion either by cash, Visa/Mastercard, certified bank check or cashier?s check, or bank wire transfer. It is the responsibility of the bidder to arrange method and delivery of payment with AAA Auction Service, Inc. within 48 hours of auction completion.

5. REMOVAL: All items must be paid for in full before they may be removed from auction location. All items MUST be removed from auction location during announced removal period. AAA Auction Service, Inc., will not be responsible for goods remaining after announced removal period. All rigging, loading, removal, and associated expense, risk and liability are the responsibility of the buyer.
If purchaser hires or contracts with a machinery mover, rigger, or other type of outside contractor, PROPER INSURANCE protecting AAA Auction Service, Inc., and the seller against any and all claims arising from personal injury and/or property damage created by that contractor?s actions must be provided.

6. CONDITION OF ARTICLES SOLD: Neither AAA Auction Service, Inc., nor the seller, shall be responsible for the correct description, genuineness, authenticity of, or defect in any article. AAA Auction Service, Inc., will make a good-faith effort to correctly describe all articles and their condition; however, neither AAA Auction Service, Inc., nor the seller, will make any guarantee or warranty regarding the accuracy of article descriptions.

NO SALE WILL BE VOIDED OR ADJUSTED TO ACCOUNT FOR INCORRECT DESCRIPTION, CATALOG ERROR, OR IMPERFECTION NOT NOTED. ALL ITEMS ARE SOLD AS-IS, WHERE-IS, WITH NO WARRANTIES EXPRESSED OR IMPLIED. IT IS THE RESPONSIBILITY OF THE BIDDER TO INSPECT ALL ARTICLES BEFORE BIDDING!

All articles will be made available for public inspection during announced inspection periods. Bidders may also contact AAA Auction Service, Inc., at any time prior to the auction to discuss articles being sold or request additional photographs. It is the responsibility of the buyer to satisfy all inquiries regarding article description and condition prior to bidding.

6. SAFETY DEVICES: Articles purchased may not incorporate approved activating mechanisms, operating safety devices or safety guards, as required by OSHA or otherwise. It is purchaser's responsibility that articles purchased be so equipped and safeguarded to meet OSHA and any other requirements before placing such articles into operation.

7. INDEMNIFICATION: Purchaser shall defend and indemnify and hold auctioneer and seller harmless from and against all claims and liabilities relating to the condition of, removal of, or use of the articles purchased or failure of user to follow instructions, warnings or recommendations of the manufacturer, or to comply with federal, state, and local laws applicable to such articles, including OSHA requirements, and Environmental Protection Agency requirements, or for proximate or consequential damages, costs or legal expenses arising there from.

8. RESPONSIBILITY FOR ARTICLES: At the time each article is sold, ownership of and responsibility for that article is transferred immediately to winning bidder. AAA Auction Service, Inc., will make a good-faith effort to protect all articles from damage or theft until the end of announced removal period; however, neither AAA Auction Service, Inc., nor the seller will be held responsible for articles after they are sold. After articles are removed from auction location or the announced removal period has ended, AAA Auction Service, Inc., and the seller will have no obligation to the winning bidder and no responsibility for articles sold.

9. COMPLIANCE WITH TERMS OF PAYMENT AND REMOVAL: In the event that a winning bidder does not pay in full within 48 hours of auction closure, AAA Auction Service, Inc., may, in addition to all other remedies allowed by law, retain all monies received as deposit or otherwise as liquidated damages. Articles not paid for and removed within the announced payment and removal times may be resold at public or private sale without further notice, and any deficiency, together with all expenses and charges of resale, including legal fees, will be charged to the defaulting purchaser.

10. RESERVE POLICY: In accordance with the laws of the State of Indiana, AAA Auction Service, Inc., has the right to accept or reject any or all bids on behalf of the seller. In accordance with the laws of the State of Indiana, AAA Auction Service, Inc., has the right to bid on behalf of the seller.

11. ACCEPTANCE OF TERMS AND CONDITIONS: Any and all bids made by any and all bidders are legally binding contracts to purchase articles for the price offered according to the terms and conditions listed herein.

12. AMENDMENT/ADDENDUM TO TERMS AND CONDITIONS OF AUCTION: Any amendment or addendum to the terms and conditions of the auction will be announced by AAA Auction Service, Inc., prior to the start of the auction and will supersede the applicable terms and conditions listed herein.
