TERMS OF SALE: 25% DEPOSIT CASH, WIRE TRANSFER OR CERTIFIED CHECK

15% BUYERS PREMIUM APPLIES ON ALL ONLINE PURCHASES

In order to bid online we must receive a 25% deposit in a certified or bank check; wire transfer;

or a company/personal check accompanied with a letter of guarantee from your bank prior to the auction.

TERMS OF SALE

1. All purchasers are required to give full name, address and telephone number.
2. Each purchaser will be required to give a deposit of 25 percent.
3. All deposits and final settlements must be made in CASH, CERTIFIED CHECKS or WIRE TRANSFER payable to the order of AARON POSNIK & CO., INC.
4. All bills must be paid in full by THURSDAY, MAY 21^ST.
5. Purchases must be removed by FRIDAY, JUNE 19^TH.
6. In default of payment of bills by THURSDAY, MAY 21^ST. Auctioneer will resell the goods by private or public sale, with or without notice to the purchaser, and deficiency, if any, and charges attending resale, if any, will be charged to the defaulting purchaser.
7. CONDITION OF ARTICLES SOLD – the lots shall be taken away and paid for at the buyer’s risk and expense within the time announced by the Auctioneer, the Auctioneer not being responsible for the correct description, genuineness, authenticity or defect in any lot, and making no warranty in connection therewith.  No sale will be set aside nor allowance made on account of any incorrectness, error in cataloging, or any imperfection not noted.  No deductions on damaged articles, all goods are exposed for public exhibition, and is sold “as is,” without recourse and with a disclaimer of warranties.  Purchases will be delivered only upon presentation of receipted bill therefor.
8. REMOVAL, EXAMINATION AND PAYMENT – No lot can on any account be removed during the sale and the full purchase money on all lots sold to the same buyer must absolutely be paid within the time fixed and before the examination or removal of the goods.
9. RESPONSIBILITY FOR NON-DELIVERY – The Auctioneers shall not in any event be liable for non-delivery or for any other thing to any purchaser of any lot other than for the return to the purchaser of the deposit or sum paid on said lot.

10. RISK TO PERSON OR OF PROPERTY – Persons attending during exhibition, sale of and removal of goods assume all risks of damage of or loss to person or property and specifically relieve the Auctioneers from liability therefor.

11. ADDITION TO OR WITHDRAWAL FROM SALE – The Auctioneers reserve the right to withdraw from sale any of the property herein listed or to sell at this sale property not herein listed, and also reserve the right to group one or more lots into one or more selling lots or to subdivide lots into two or more selling lots.

12. In case of dispute on knockdown of any lot, the Auctioneer reserves the right to put up the lot for sale again at once, and resell to the highest bidder.

13. Auctioneer has sole and exclusive right to: (i) refuse any bid deemed too small; (ii) set minimum increased bidding increments; and (iii) sole and exclusive right to determine, with finality, disputes of any kind between auctioneer and bidder.

14. No goods will be delivered during the sale, nor will any claims be allowed after goods leave the premises.

15. Not responsible for goods not removed by FRIDAY, JUNE 19^TH.

16. The record of sale kept by the Auctioneer or Bookkeeper will be taken as final in case of any disputes.

17. All bills must be paid to representatives of AARON POSNIK & CO., INC.

18. SALES TAX – All sales are subject to state and local taxes, unless a proper exemption certificate including tax exempt number is presented at the time of payment.

19. BUYER’S PREMIUM – The Auctioneer in its sole discretion may impose a Buyer’s Premium on any goods sold.  The Buyer’s Premium is a percentage that is added to the final purchase price of any item.  Applicable Buyer’s Premium will be posted on the website.

These terms and conditions will be superseded by the Terms and Conditions announced at the time of the auction.
