Who May Attend This Auction
This auction is open to the general public and everyone is invited to bid and buy at this auction. There is no cost to register and bid.
No Warranties:
All auction properties are sold in “as is, where is” condition. Seller makes no warranty as to the condition or the specific usefulness of any item sold. There are no refunds or exchanges.
Buyer’s Premium:
A buyer’s premium of ten percent (10%) will be added to the high bid to determine the total price to be paid. The full amount of the bid and buyer’s premium must be paid in full immediately after the auction. There is an addtional 3% convenience fee for bids placed online.
Inspection:
All items must be inspected must be made prior to the auction date. Please do not bid on any property until you have thoroughly inspected the property.
Payments:
Payments will be direct to the auction company, not through BidSpotter. Payments must be in the form of cash, cashier’s check, company check or credit card. There is a 3% additional fee for paying by credit card.
Riggers:
You may contact any rigging company you wish to. We recommend E & R CRANE & RIGGING in Memphis, TN. 901-775-5195.
Load Out (IMPORTANT)
All items must be loaded out after the auction until 6:00 Auction Day or 9:00 a.m. to 4:00 p.m. the day after the auction. You must bring any equipment and labor to move the items that you win the bid for. There will be no moving labor on site. You are responsible for hiring riggers or electricians to remove any equipment.

Governing Law
These Bidder Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Tennessee, including its statutes of limitations, but without regard to its rules governing conflict of laws. All claims, disputes and other matters between the parties shall be brought in the state or federal courts sitting in and for Shelby County, Tennessee, which courts shall have exclusive jurisdiction, and shall be the exclusive venue, for any and all such claims, disputes, and other matters. By submitting a Bidder Registration and accepting a Bidder Number, each Registered Bidder irrevocably and unconditionally (i) agrees that any claim, suit or cause of action relating to these Bidder Terms and Conditions, or the transactions contemplated hereby, shall be brought in the state or federal courts sitting in and for Shelby County, Tennessee, (ii) consents to the jurisdiction of such courts for any such claim, suit or cause of action, (iii) waives any objection that such party may have to the laying of venue of any such claim, suit or cause of action in such courts; and (iv) waives any objection to the bringing of such claim, suit or cause of action in such courts on the grounds of forum non conveniens.
