Terms and Conditions

1. Registration:

All bidders must
register at the cashier’s desk
prior to the SALE, at which
time you will be presented
with
a bidder paddle & this number
must be visible to participate
in the bidding.

2. Terms:

All purchases are to
be paid in full in U. S. funds
on the day of the auction in
CASH or CASHIER`S CHECK, Visa
and Mastercard. Company
checks are only accepted when
accompanied by a Bank
Guarantee letter. No
exceptions. The
purchaser shall not be
entitled to possession on any
part or
parts of any of his purchases
until the total purchase price
of all his purchases has been
fully paid. All checks are to
be made payable to Continental
Plants. 12% Buyer’s Premium
will apply to all purchases.
15% for online bidders.

3. Sales Tax:

All applicable Sale
Tax will be added to the
purchase price of all taxable
purchases unless purchaser
files a written “proof of
exemption” satisfactory to the
Auctioneer and the governing
authority. Sales tax for “Out
of state buyers” will be
collected as per letter
furnished
by the cashier.

4. Warranty:

All items are sold “as-is
where-is.” The description of
items appearing in the catalog
and in our advertising prior
to this sale are believe to be
correct. Nevertheless,
neither those descriptions nor
any oral statements made by
OWNER or AUCTIONEER concerning
any item shall be construed
as a warranty, either express
or implied. It is the buyer’s
responsibility to inspect the
equipment and to make his own
inquiries and judgment prior
to bidding.

5. Owner Responsibility
and Removal:

Purchases become the
responsibility of and shall be
and
remain at the risk of the
Purchaser immediately upon
acceptance of his bid. It is
the responsibility of the
purchaser to insure his
purchases immediately. All
purchases must be removed from
the auction site within the
time and in according to the
procedures announced. All
cost, responsibility and risk
shall be borne by the
purchaser. A purchaser is
deemed to have accepted a lot
when he makes his bid. All
third party riggers must
provide
the AUCTIONEER with proof of
licensure and certificate of
insurance prior to working on
premises. Electrical,
plumbing and gas work must be
performed by licensed
individuals.

6. Manner of Offering:

The Auctioneer reserves the
right to group lots, make lots
smaller or to add or delete at
his discretion – as well as
the right to offer
individually and/or by group.
He also
reserves the right not to
accept or acknowledge any bid
which is merely a fractional
advance over the preceding
bid.

7. Disputes Between
Bidders:

The AUCTIONEER shall designate
the Purchaser after each item
of merchandise is auctioned.
If a dispute arises between
bidders, the Auctioneer will
have to reopen the bidding or
designate the purchaser. His
designation is final.

8. Auctioneer:

The AUCTIONEER shall
have the right to resell any
property not paid for on the
sale day as required by this
contract. The defaulting
buyer agrees to indemnify and
hold
AUCTIONEER harmless for any
expenses of resale and
collection and any damages
resulting from sale.

9. Adjustments:

Errors in estimates of
merchandise inventory will be
adjusted, but no adjustment
will be made after merchandise
has been moved from its place
of sale, handled by the
Purchaser or after the removal
dates as listed on the Sale
invoice and announced by the
Auctioneer at the start of the
sale, whether or not the
property has been removed.
All
adjustments must be
authenticated by the
Continental Plants
lead check-out man. In no
cases will any adjustments be
made after the property has
been removed.

10. Receipt:

The BUYERS will be furnished a
computer receipt at the time
of payment. This original
receipt must be presented to
and
authenticated by the check-out
man before BUYER will be
permitted to remove purchases
from the sale premises.
