COVID-19 PRECAUTIONS: All persons are required to practice social distancing, wear protective masks and/or face coverings while on site. This applies to any inspections and removal of purchases.  

BIDDER REGISTRATION: All Participants are required to register with Bidspotter.com and must be approved by United Country Heartland Realty & Auction, LLC. All purchasers are required to give actual full name, company name, address, contact phone number, email address and signature.  Bidder’s paddles are nontransferable.  All bids made by the holder of the paddle will be the responsibility of the registered bidder.  A successful bid at auction constitutes a legally binding contract of sale.  All sales are final.  No refunds, returns or exchanges.  Any person attending inspection day, auction sale day or during the removal period assume all risks of damage or loss to person.  ALL BIDDERS MUST REGISTER ON-LINE AND BE APPROVED IN ORDER TO BID AT LEAST 48 HOURS PRIOR TO BIDDING ON LINE!!  NO EXCEPTIONS!!

CREDIT / DEBIT CARD DEPOSITS: This auction may require a credit or debit card deposit for some bidders. Your credit / debit card added through the Bidspotter.com is fully secure and PCI compliant registration process will be charged a $10.00 deposit in order to be approved to bid within the auction. Some bidders will not be approved without your credit card entered at the stage of registration being charged a deposit of $100.00.

PAYMENT: Invoices must be paid in full by Friday, July 31, 2020.   Payment may be made by wire transfer, company check with a bank letter of guarantee, certified funds, cash, Visa, MasterCard or Debit Card. Sales tax may be added to each purchase unless the buyer has provided the proper exemption certificate via email to (UCHeartland@gmail.com). NO PURCHASES WILL BE RELEASED UNITIL INVOICE(S) ARE PAID IN FULL. NO EXCEPTIONS!

BUYER PREMIUM: The will be an 18% Buyers Premium added to the final bid of each lot to establish the contract selling price, plus applicable sales tax. Example with 18% Buyers Premium: Bidder bids $100.00. Bidder is invoiced $118.00 plus applicable sales tax.

INSPECTION: Buyer(s) hereby acknowledges that Buyer or Buyers Agent has inspected and/or has had the opportunity to inspect all items bid on and/or purchased. We encourage your personal inspections and due diligence, prior to bidding.

CONDITION OF SALE: All Items are sold on “As Is- Where Is”, “In Place”, “with all faults” with no conditions as to warranties or representation, written or oral, is given with any lot. All statements contained in the catalog, website, and marketing material or by the auctioneers, or in any bill of sale, invoice or elsewhere as to description, size, quantity, quality, capacity, model, serial number, measurements or condition, are approximated statements and shall not be deemed to be representations or warranties, oral or written, with respect to any lot. No sale is invalid or made void by reason of any flaw in a lot or by reason of a lot being incorrectly described. Descriptions and photos are not guaranteed and we encourage the buyer(s) to inspect, prior to biding. 

REMOVAL OF PURCHASES: All itemsmust be removed by Thursday, August 13, 2020 by 2:00 PM. Failure to remove items by the end of the removal period will automatically result in forfeiture of the item. There will be no refunds whatsoever. Prior to removal, all items must be paid in full. The purchaser shall be responsible for all costs of removal and shall be liable for damages, including without limitation, any environmental damages caused during or as a result of the removal. Purchasers shall comply with all environmental laws and regulations and all requirements established by the auctioneer for the removal of purchases. Purchasers are solely responsible to properly remove and store in appropriate containers all fluids, oils, hazardous chemicals, etc.… from equipment purchases. Rigging companies must provide an insurance certificate for 1,000,000.00 naming United Country Heartland Realty & Auction, LLC (Auctioneer), landlord and/or property owner and sellers as an additional insured against any or all claims arising from personal injury and/or property damage created by their actions.

Small items (Tooling, Machine Parts & Accessories, and Office Furniture - Items that can be hand carried) are to be REMOVED WITHIN 2 DAYS OF THE AUCTION. NO SATURDAY OR SUNDAY LOAD-OUT.

All other Machinery & Equipment must be removed by Thursday, August 13, 2020 by 2:00 PM and purchasers are required to contact auctioneers to schedule an appointment for removal.

DISCONNECT & REMOVAL: United Country Heartland Realty & Auction, LLC (Auctioneer) does not provide load-out labor or equipment, we do not pack, ship, crate, transport or rig items. As a courtesy only, auctioneer may provide contact information for riggers, machinery movers or other service providers. Auctioneer is not affiliated with, nor shall auctioneer be responsible or liable for the action of any rigger, machinery mover or other service provider utilized by a bidder or bidders authorized representative.

BIDDER, hereby expressly represents, warrants, covenants and agrees that BIDDER has received, read, fully understands, accepts and herebyacknowledges and agrees to be legally bound by all of the Terms & Conditions of this AGREEMENT as stated above and shall be bound by and comply in all respects with and shall be liable for breaches of the forgoing terms and conditions and further hereby agrees to abide by any and all posted notices and announcements made hereafter pertaining to the terms and conditions of this auction sale whether present or not by BIDDER’S ELECTRONIC ACCEPTANCE OR signature below. Auctioneer at its sole discretion may deny registration or bidding at any time to any person or entity. Purchasers may not transfer or exchange items/invoices and all sales are final.
