REGISTRATION:  $100.00 refundable deposit is required when you register to bid.  This will be refunded after the end of the auction after winning bidders invoices have been paid in full.  Bidders who participated in the auction without any winning bids will have their refunds processed at the end of the day on April 23rd 2020.  After you submit your registration information to Bidspotter, your credit card on file with Bidspotter will be charged for the $100.00 refundable deposit.

OUT OF STATE BUYERS PLEASE NOTE:  Auction items held in California are considered sold 'WHERE IS" by the State of California Dept of Tax and Fee Administration.  Therefore the State of California charges sales tax on auction items and the buyer's premium.  The State of California DOES NOT recognize out of state resale numbers.  Please refer to the State of California Dept of Fee and Tax Administration website for more information.

REMOVAL TERMS:  Winning Bidder is responsible for removal of all items no later than April 29, 2020, 12 noon,  or by prior arrangement with auctioneer.  Winning Bidder is responsible for making shipping arrangements or pickup.  We will need your name, your paddle number, name of the carrier that you will be using and date and time of pickup.

RIGGING:  Rigging is also at the Winning Bidder's own expense, risk and liability.  A certificate of insurance in the amount of $1,000,000.00 naming Cooperage/Ames Partnership and Silicon Valley Auction Service as additional insured entities must be presented to Silicon Valley Auction Service for all heavy rigging requiring the use of forklifts, cranes, etc. whether performed by Winning Bidder or the rigging company.  Winning Bidder shall restore and repair all real and personal property that is altered or damaged as a result of Winning Bidder's removal of the purchased items.  Silicon Valley auction Service has the right to reduce or eliminate these requirements at its sole discretion.

18% BUYER`S PREMIUM WILL APPLY TO ALL PURCHASES.

California sales tax of 9.25% will be charged on all items and buyer's premium unless the Winning Bidder has a valid CALIFORNIA SALES TAX CERTIFICATE on file with Silicon Valley Auction Service.  Email diana@svauctions.com for a copy of this certificate to be completed by Winning Bidder prior to end of auction.

All items are sold "as is, where is" and there is no warranty, implied, written or verbal as to the condition, accuracy or value of any item sold.

PAYMENT: in addition to major Credit Cards and Debit Cards, we will accept cash, cashier`s check, wire transfer or PayPal.  Buyer's Premium  and local sales tax will be charged on all purchases.  The credit card you use for registration will be used to process your payment at the end of the auction unless you notify Silicon Valley Auction Service to make other payment arrangements PRIOR to the end of the auction (diana@svauctions.com).   FULL SETTLEMENT OF YOUR INVOICE WILL BE REQUIRED WITHIN 48 HOURS AFTER THE END OF THE AUCTION SALE. All sales are final and are payable at the conclusion of the sale. A buyer`s premium and local sales tax will be charged on all purchases.

REGISTRATION:  This auction will require a refundable credit or debit card deposit.  Your credit/debit card through BidSpottercom is fully secure  and PCI compliant. Registration process will be assessed a $100.00 deposit in order to be approved to bid within the auction.  You will not be approved without your credit card entered at the stage of registration being assessed a refundable deposit of $100.00.  After you submit your registration information to Bidspotter, your credit card on file with Bidspotter will be charged for the $100.00 refundable deposit.

CREDIT/DEBIT CARD PAYMENTS;  Payments via credit/debit card are accepted up to $5,000.00 final invoice total.  Any invoice total larger than $5,000.00 must be paid by cash, wire transfer, or certified check.  Your deposit may be applied to your final invoice amount, even if your final invoice is larger than $5,000.00.  Your pre-authorization will be credited back within 24 hours after the end of the sale.

CHARGEBACKS:  As a condition to registration and bidding, Winning Bidder agrees that Winning Bidder will not, under any circumstance, initiate a chargeback to Winning Bidder's credit card.  Winning Bidder further agrees that Winning Bidder is waiving any chargeback rights that may exist under the agreement between Winning Bidder and Winning Bidder's credit card company.  Should a chargeback be initiated by the Winning Bidder, these terms and conditions will be conclusive evidence of the Winning Bidder's waiver of any chargeback rights.  All sales are final.

Non-payment:  If any Winning Bidder fails to pay their invoice in full within the time herein specified, Silicon Valley Auction Service reserves the right to charge the Winning Bidder's credit card that was used at time of registration for any unpaid balance on an invoice plus a 18% buyer's premium.


REMOVAL OF PURCHASES: Cost, responsibility, and risk of removal of purchases remain with the Winning Bidder.  It is the Winning Bidder`s responsibility to restore/repair all real or personal property that is altered or damaged as a result of the removal. Purchases must be removed from the premises in the time allocated as announced and/or posted by the auctioneer. Silicon Valley Auction Service reserves the right to charge the purchaser for the costs of storage and/or disposal beyond the removal period. Items not picked up in the time allocated will be considered abandoned. NO purchases may be removed until after the conclusion of the sale and payment is received in full.  The Winning Bidder should contact Silicon Valley Auction Service to provide the shipping method preferred, including providing paperwork required for pickup, name and phone number of shipping company, date and time for pickup. 
No claims of any kind shall be allowed for any item not removed or after an item has been removed by the purchaser.

Everything will be sold "AS IS", "WHERE IS", "AS AVAILABLE", "WITH FAULTS", with no representations, expressed or implied. Silicon Valley Auction Service, as agent and seller, expressly disclaims any warranty as to fitness or usability of all assets, and the winning bidder expressly waives any purpose whatsoever. Silicon Valley Auction Service, seller and/or advertising agents will not be held responsible for advertising inaccuracies or discrepancies. Prospective bidders are advised that Silicon Valley Auction Service does not guarantee the accuracy of description or condition of the subject property. Prospective bidders are urged to inspect all items.  Deductions will not be allowed on damaged goods since everything is sold "as is, where is" and without recourse.

No advice or information, whether written or verbal, obtained by a prospective bidder from Silicon Valley Auction Service shall create any warranties or responsibility for items purchased. The purchaser hereby assumes and does agree to indemnify and hold Silicon Valley Auction Service and seller harmless from any future claim which shall pertain to the fitness or use of the item being purchased. 

Limitations of Liability: For any reason whatsoever, if an item purchased cannot be delivered, the buyer waives liability on the part of Silicon Valley Auction Service and further agrees that any obligation of said item is limited to the bid and paid for price of item. Persons attending the auction preview, sale, or removal assume all risks of damage or loss to person and property and specifically release and indemnify Silicon Valley Auction Service and seller
from liability. Silicon Valley Auction Service and/or seller shall not be liable by reason of any defect in or condition of the premises in which the sale is held. 

The record of sales kept by the auctioneer and clerk will be taken as final.

Auctioneer`s Note: The auctioneer reserves the right to withdraw from the sale any of the items, to sell items not listed, to group or subdivide one or more lots, or to sell all the items listed in bulk. Items are generally sold to the highest bidder but some may be subject to the seller`s right of confirmation. The Auctioneer has the right to reject any nominal or fractional bid which he believes may negatively affect the sale.  Silicon Valley Auction Service
