Auctioneers Terms and Conditions

By making a bid, Bidder accepts the terms and conditions below and will be bound by them.

Terms may vary from sale to sale. Bidders should always review the sale details for specific information. Industrial Bay International Auctions referred to herein as IBIA.

IBIA makes every effort to accurately describe all items, but there is the possibility of error. IBIA is not respondible for any errors or omissions in the description of merchandise.     The record of sales kept by the auctioneer and clerk will be taken as final.

Removal - Buyers are responsible for removing all purchased lots from site by removal deadline as specified (or IBIA notified of arrangements). All items become the sole responsibility of the purchaser upon final bid acceptance. Removal shall be at the expense, liability, and risk of the purchaser. IBIA shall not be responsible for goods not removed within the time specified, and shall have the option of removing and storing or reselling at the expense and risk of the purchaser any article purchased. 

There will be NO removal allowed the day of the sale.

Standard removal hours are 8:00 AM to 4:00 PM Monday June 4th through Wednesday June 6th EST. (or IBIA notified of arrangements  sherman@industrial-bay.com)

To Release - A buyers release in the form of IBIA issued receipt of payment must be supplied to IBIA personnel at the time registered bidder or authorized representative is picking up auction purchases.

We require payment within 24 hours after the auction has ended. Wire transfers, credit card transactions (directly on auction site) or virtual credit card transactions (sue@industrial-bay.com) must clear in order for payment to be considered received in full.  ALL monies are due in USA dollars.

In the event that I do not contact IBIA by 12 noon EST the day after auction closes (Fri. June 1st 11:30am) for above payment method; I authorize Industrial Bay International Auctions (IBIA) to process payments on the registered credit card on file without the approval of the cardholder for each outstanding invoice of winning paddle/bids. I certify that I am an authorized user of this credit card and that I will not dispute the payment with my credit card company; so long as the transaction corresponds to an "Winners notification note" and/or an invoice issued by IBIC for goods that I bid upon and won.

Conditions - All property is sold "AS IS, WHERE IS". IBIA and its consignors, agents, employees, directors or principals do not make any representation or warranty, oral or written, expressed or implied, as to the merchantability, fitness for a particular purpose, condition of the property, correctness of the description, condition, capacity, age or any other details used to describe the property. 

Bidding is on items listed in the lot descriptions and not all items shown in the photographs.

Items purchased may not incorporate approved activating mechanisms, operating safety devices or safety guards, as required by OSHA, CCOHS or otherwise. It purchaser`s responsibility that articles purchased be so equipped and safeguarded to meet OSHA and any other requirements before placing such articles into operation. 

Absolutely NO RETURN of sold goods, NO REFUNDS, and NO EXCHANGES will be permitted.

Indemnification - Buyer shall defend and indemnify and hold auctioneer and seller harmless from and against all claims and liabilities relating to the condition of, removal of, or use of the articles purchased or failure of user to follow instructions, warnings or recommendations of the manufacturer, or to comply with federal, state or provincial, and local laws applicable to such articles, including OSHA requirements, and Environmental Protection Agency requirements, or for proximate or consequential damages, costs or legal expenses arising there from.
