Invoice: All successful online bidders will receive an invoice by email within 24 hours of the close of the timed online sale. All sales are Final.

Payment: Online sales must be paid for in full within 24 hours of receiving the invoice Accepted methods of payment are wire transfer or certified/cashier check. Mastercard & Visa will be accepted for an additional 2% admin fee. 

Rigging: Lot #6 and Lot #7 each have a $750.00 rigging cost. All other Lots do not, unless special requirements are requested by the buyer (ie: crate, skid, etc.)

No self rigging – no exceptions.

All Bidders must provide their FULL NAME, COMPLETE ADDRESS, PHONE NUMBER & EMAIL ADDRESS at which they can be contacted at the time of registration.

ALL ITEMS ARE SOLD AS IS, WHERE IS, WITHOUT GUARANTEE OF ANY KIND. The descriptions of items appearing in advertising prior to this auction are believed to be correct. Nevertheless, neither those descriptions nor any oral statement made by the owner (or his agents or officers) or by the Auctioneers (or his agents or officers) concerning any item shall be construed as a warranty, either expressed or implied. I, bidder have examined this merchandise and accept it the way it is. All mileage & hour meters on vehicles and equipment are not guaranteed by auction company or any of its representatives. DISPUTES: The Auctioneers shall designate the winning bidder after each item is auctioned off. If a dispute arises between two or more bidders, the Auctioneers reserve the right to reopen the bidding. The Auctioneers designation of a buyer shall be final. INJURY AND DAMAGE AND HOLD HARMLESS: Bidder acknowledges responsibility for any Personal injury property damage caused by bidder or his agent, and further agrees to hold auctioneers and owner harmless for any and all personal injury to himself or his agents and any property damage incurred on auction premises. Buyer agrees to hold auctioneers and owner, their agents or employees, harmless from any and all suits, claims damages, cost and expenses of every kind and nature which may or might be asserted against the auctioneer or owner, their agents or employees, resulting from the actions or inactions of buyer. Buyer agrees and understands that by law employers are required to carry workers compensation coverage for its employees. Buyer is responsible for the providing of worker’s compensation, liability and property damage insurance as respects their property and contractual obligation.

Removal: All items awarded become the sole responsibility of the successful bidder at the close of the timed online sale. Galick Packaging is not responsible for any issues related to the safe handling and transport of merchandise purchased from the timed online sale. Buyer assumes all risk of loss and damage to property until removed from the sales premises. Removal shall be at the sole risk and liability of the buyer, including the cost and proof of insurance. All purchased item(s) shall be removed in their entirety from the site(s). The buyer must repair or replace any damage that occurs during the removal. Third party removal or shipping parties must be approved by both the seller and buyer. Buyer is responsible for third party’s risk and liability. All item(s) must be removed by the determined timeline set forth in the timed online sale. Removal shall be completed by the predetermined timeline or the purchased item(s) will be considered abandoned and bidder will be considered in default and ownership will revert back to the Seller. 

Payment Default: Failure to pay invoices in full by the Final Payment Date in accordance with payment terms will subject Bidder to pay as Liquidated Damages a sum equal to the lesser of (1) 20 percent of the invoice price of the item(s) as to which the default has occurred, or (2) the full amount of the difference between the original invoice price and the re-sold price plus any expenses incurred to re-market or re-sell these items.
