Disposal under this Section shall not release buyer from their obligation to pay the Removal Penalty described in Section 9. By placing a Bid, Bidders expressly acknowledge and accept these terms, whereby the remedy for THE AUCTIONEER having withdrawn any Lot(s) falling under the purview of this Section, shall be expressly limited to a refund of any monies already paid to THE AUCTIONEER. THE AUCTIONEER retains the rights and privileges of this Section so long as the Lot(s) remain on the premises. Any controversy or claim relating to these Terms shall be settled by arbitration in accordance with the Rules of the American Arbitration Association, either the Mexican laws, and judgment upon the award (which shall include attorneys’ fees to the prevailing party), rendered by the arbitrators may be entered in any court having jurisdiction thereof. This Section notwithstanding, in the event either party hereto institutes any suit or action to enforce its rights hereunder the prevailing party shall be entitled to reimbursement of its costs and expenses, including without limitation reasonable attorneys’ fees. • Disputas: En caso de disputa sobre la Licitación, EL SUBASTADOR podrá, a su sola discreción, aceptar lo que considere que es la oferta final, solicitar más ofertas sobre el artículo en disputa o retirar (o retirar retroactivamente) el lote(s) o bienes(s) sin sanción o recurso, excepto según lo permitido en este documento. EL SUBASTADOR conserva los derechos y privilegios de esta Sección siempre y cuando el/los Lote(s) permanezca(n) en las instalaciones. Cualquier controversia o reclamo relacionado con estos Términos se resolverá mediante arbitraje de acuerdo con las Reglas de la Asociación Estadounidense de Arbitraje así como de las leyes mexicanas, y el fallo sobre el laudo (que incluirá los honorarios de los abogados de la parte vencedora) dictado por los árbitros se puede ingresar en cualquier tribunal que tenga jurisdicción sobre el mismo. No obstante lo dispuesto en esta Sección, en caso de que cualquiera de las partesinicie una demanda o acción para hacer valersus derechos en virtud del presente, la parte ganadora tendrá derecho al reembolso de sus costos y gastos, incluidos, entre otros, los honorarios razonables de los abogados. • Payment Terms: The last day for the payment is December 8, 2022. It is highly recommended that if you wish to utilize any method of payment other than bank Wire Transfer, you call our office to explain your particular circumstance and obtain prior approval from appropriate THE AUCTIONEER staff. A list of acceptable forms of payment can always be found in the auction catalog, on the THE AUCTIONEER website and on your invoice.
