RIGGING: Rigging is also at Winning Bidders's own expense, risk and liability. A certificate of insurance in the amount of $1,000,000.00 naming Silicon Valley Auction Service as additional insured entities must be presented to Silicon Valley Auction Service for all heavy rigging requiring the use of forklifts, cranes, etc. whether performed by the Winning Bidder or a rigging company. Winning Bidder shall restore and repair all real and personal property that is altered or damaged as a result of Winning Bidder's removal of the purchased items. Silicon Valley Auction Service has the right to reduce or eliminate these requirements at its sole discretion.

All attendees must also sign a waiver for Fagerroos Engineering Inc and Silicon Valley Auction Service in order to pick up their items and attend the preview.
Buyer is responsible for arranging rigging, pallatizing, and shipping company for their winning items. We do not provide staff or refer companies to make these arrangements. If you are picking up your items in person, please bring any necessary assistants to load your items.

THIS AUCTION TAKES PLACE IN SAN LEANDRO, CALIFORNIA - PLEASE READ ALL OF THE TERMS AND CONDITIONS BEFORE BIDDING. WE DO NOT PROVIDE OR ARRANGE SHIPPING. OUT OF CALIFORNIA BIDDERS PLEASE NOTE. This auction is limited to buyers in the 48 domestic United States.
THERE IS A $100 REFUNDABLE DEPOSIT REQUIRED WHEN REGISTERING TO BID ON BIDSPOTTER. THIS DEPOSIT WILL BE REFUNDED AT THE END OF THE AUCTION UNLESS THE BUYER HAS NOT PAID FOR THEIR INVOICE IN FULL. IN THAT CASE, THEIR DEPOSIT IS FORFEITED FOR FAILING TO FULFILL THEIR OBLIGATION UNDER THE TERMS AND CONDITIONS WHEN REGISTERING.
Payment is by credit/debit card and we will use the credit/debit card the buyer used to register with Bidspotter for payment UNLESS arrangements are made for a different method of payment within 24 hours of the end of the auction. The maximum amount you may charge on your debit/credit card is $5,000.00. Invoices with amounts due over $5,000.00 will need to be paid by wire transfer or ACH payment. Sorry, no third party credit/debit cards will be accepted for registration or payment.
18% BUYER`S PREMM WILL APPLY TO ALL PURCHASES. Alameda County Sales Tax will be added unless winning bidder has a CALIFORNIA resale certificate on file with Silicon Valley Auction Service. Please contact (email) diana@svauctions.com to have a resale certificate sent to you to complete and return to us. Resale certificates must be on file with Silicon Valley Auction Service BEFORE the end of the auction.
California sales tax of 10.75% will be charged on all purchases unless buyer has a valid CALIFORNIA SALES TAX CERTIFICATE on file with Silicon Valley Auction Service.
OUT OF STATE BUYERS PLEASE NOTE - Auctions held in California are considered sold "where is" by the State of California. Therefore, the State of California DOES NOT recognize out of state resale tax numbers. Please check the California Dept of Taxes and Fees website for more information. IF YOU DO NOT HAVE A CALIFORNIA RESALE CERTIFICATE ON FILE BEFORE THE END OF THE AUCTION YOU WILL BE CHARGED SALES TAX AND MUST PAY THE SALES TAXES ON YOUR INVOICE. ONCE YOU HAVE SUBMITTED A COMPLETED CALIFORNIA SALES CERTIFICATE YOUR PAID SALES TAX WILL BE REFUNDED TO YOU BY CHECK.
BIDSPOTTER WILL SEND YOU AN INVOICE AT THE END OF THE AUCTION. PLEASE CHECK ALL OF YOUR EMAIL MAILBOXES FOR THIS INVOICE. Silicon Valley Auction Service will not send you an invoice.
PAYMENT: Wire Transfer or Major Credit Card or Debit Card (we do not accept Discover Card). FULL SETTLEMENT TO BE MADE WITHIN 24 HOURS AFTER THE END OF SALE INCLUDING CASH PAYMENTS THAT MUST BE PROCESSED WITHIN 24 HOURS AFTER THE END OF THE AUCTION. Credit card payments will be processed within 24 hours after the close of the auction. All sales are final and are payable at the conclusion of the sale. A buyer`s premium and local sales tax will be charged on all purchases. Credit card used to register will be used to process payments due at the end of the auction UNLESS prior arrangements are made with the auctioneer. Your registration with your credit card authorizes Silicon Valley Auction Service to use this credit card for payment unless other arrangements are made within 24 hours of the end of the auction. CHARGEBACKS: As a condition to registration and bidding, Buyer agrees that Buyer will not, under any circumstance, initiate a chargeback to Buyer's credit card. Buyer further agrees that Buyer is waiving any chargeback rights that may exist under the agreement between Buyer and Buyer's credit card company. Should a chargeback be initiated by Buyer, these terms and conditions will be conclusive evidence of Buyer's waiver of any chargeback rights. All sales are final.
NON-PAYMENT: If any Buyer fails to pay their invoice in full within the time herein specified, Silicon Valley Auction Service will have the right to resell your winning lots.
