STOCK & ASSET SERVICES TERMS & CONDITIONS OF SALE

PLEASE READ OUR TERMS & CONDITIONS PRIOR TO BIDDING.

PLACING A BID CONFIRMS YOUR ACCEPTANCE OF THESE TERMS.

1) Definitions & Interpretations:
"Auctioneer”, “House”, “The Company”, "We", "Us" and "Our" means Stock & Asset Services Ltd, Unit A, Southern Avenue, Leominster, Herefordshire HR6 0QF.

“Bid”, “Bids”, Bidding”. Offer” means an agreement to purchase a lot by auction, online auction, tender or private treaty.

“Bidder” any person(s) who offers to purchase a lot by auction, online auction, tender or private treaty.

“Buyer” any person(s) who successfully offers to purchase a lot by auction, online auction, tender or private treaty.

“Catalogue” a list of items offered for sale with a general description for identification.

“Location” the address where the lots are available for viewing and collection. Details of which are shown in the special conditions of sale.

“Lot” any item or group described and identified in the catalogue and invoice.

“Special Conditions” applicable to the individual sale are as described in the catalogue, displayed at the location or detailed in advertisements or websites.

“Vendor” means the person who has instructed us to act on their behalf.

2) Description & Inspection
a.) Buyers are responsible for inspecting, researching and investigating any lots that they intend bidding on to determine their suitability or fitness for purpose. If the buyer chooses to bid without viewing or inspection then the buyer is deemed to have done so at their own risk.

b.) Whilst all lots are believed to be correctly described the lots are sold as seen with the buyers acceptance of any errors, omissions, faults or inaccuracy.

c)  Neither the Auctioneer, Vendor or their employees and Agents give any opinion, representation or warranty in relation to any lots. Therefore no liability will be accepted for any loss or damage suffered by the buyer in purchasing any lot.

3) Auction Procedure
a) The Vendor and Auctioneer may set a reserve price for any lot.

b) No bid can be withdrawn after the auction has closed.

c)  Any lot can be withdrawn from the auction at any time.

d) Any lot may be sold by private sale either before or after the auction.

e) The Auctioneer may reject any bid at his sole discretion without giving reason.

f) The Auctioneer is not responsible for any computer, technical or communications failures which may delay or prevent any bids.

g) With online auctions any bids made in the last 10 minutes of the auction will auto extend the auction close for a further 10 minutes or until no further bids have been made and 10 minutes have elapsed.

h) At the end of the online auction the final bid figures may be submitted to the Vendor for their consideration. The Vendor is not bound to accept the highest or any offer.

4) Payment & Collection
a) Title of the lot does not pass to the buyer until full payment, including the purchase price, buyers premium and VAT has been received by us.

b) An invoice will be emailed to the winning bidder as soon as possible after the auction has been completed. This will detail the winning bid prices, buyers premium and VAT. The Payment must be received within 72 hours of the auction ending.

c) Payment can be made in cash, credit card, debit card, bank transfer or Paypal.

Cash payments can be made at our office up to a maximum of £9000. Cash cannot be accepted above this level to comply with anti-money laundering regulations.

Credit & Debit card payments can be made by telephoning our office on 01432 851 008. Debit card payments are free of any further charges but Credit cards incur a 2.5% surcharge.

Payment can be made by Bank Transfer to Lloyds TSB PLC, Account Name Stock & Asset Services Ltd, Account Number 00587010, Sort Code 30-94-14. Please include the invoice number in the reference area and email our office when the payment has been sent.

Payment can be accepted by Paypal and Nochex but these are subject to a 3.2% surcharge.

Payment on collection is acceptable where the lots are stored at our premises. However, this facility is not available at other locations.

5) Bidding Deposit
a) A refundable deposit of £100 may be required to secure a bidders number. This will be charged to your credit/debit card at the point of registration. This amount will be credited against your invoice for successful bids or refunded where no purchase has been made.

b) The deposit will be forfeited where the winning bidder does not pay for the lots invoiced.

6) Buyers Premium
a) A non negotiable buyers premium plus VAT will be applied to all lots. The rate of buyers premium will be stated at each individual auction.

7) Value Added Tax
a)  VAT at the prevailing rate will be charged on all applicable lots. Where the lot is VAT exempt this will be detailed in the description.

b) All international bidders will be charged VAT on applicable lots. However, this VAT will be refunded in full once satisfactory evidence of export has been received within one month of the auction.

8) Collection & Delivery
a) All bidders must collect their lots on the dates specified for each individual sale. Usually within 5 days of the auction finishing.

b) No collection or delivery will be permitted unless the buyer has paid for all lots, commissions, fees, charges and VAT.

c) Where bidders are unable to collect within the timescale stated then items may be removed and stored at the buyers expense.

d) Packing and delivery options are available for all lots. The options and relevant costs are detailed within each lot description.

9) Governing Law
These terms and conditions and associated transactions shall be governed and construed in accordance with English Law.

10) Severability
In the event that any of the provisions of these terms & conditions are held unenforceable for any reason, the remaining conditions shall remain in full force and effect.
