of Terms:
All persons participating in the Webcast portion of bidding agree to and accept
all terms and conditions unequivocally and without exception. All
participants hereby agree and accept that neither State of Texas Building and Procurement Commission, Lone Star Auctioneers,
Inc. nor Bidspotter.com will be held responsible for any failure to
execute a bid on behalf of any participant(s) for any reason whatsoever.

Required
Deposit:
All persons desiring to bid online at this auction are required to send a Cashier's Check in the amount of $1000.00 made payable to Lone Star Auctioneers Escrow Account, 4629 Mark IV Parkway, Fort Worth, TX 76106-2295, no later than noon Friday, November 7, 2008 along with signed copies of the required Terms
and Conditions Form and Ceritfication
Form.
No online bidders will be approved until they have registered and the $1000.00 deposit & registration forms are received. The deposit is fully refundable or will be applied to online purchases at this auction only. We strongly urge bidders to overnight their deposits so that we receive them no later than Thursday, November 6, 2008. The sooner you get your deposit in, the sooner you will be approved to bid absentee and on-line. Although bidders can submit absentee bids prior to approval, those bids will not be executed until we receive your deposit. The Cashiers Checks will not be cashed unless a winning bid is submitted by that bidder. All Cashiers Checks from unsuccessful bidders will be returned within two business days after the auction.
Winner Notification:
Successful Webcast bidders will be notified immediately after the
auction. Full payment MUST be made in the form of Cashiers
Check ONLY. All payments for on-line purchases MUST be
received in our office NO LATER THAN Thursday, November 13, 2008 at 5:00pm (Please note, most banks will be closed on November 11th in observance of the Veterans Day Holiday). Any bidder(s) who do(es) not pay for their online purchases
will not be allowed to register or participate in any future Live
or Online auctions conducted by Lone Star Auctioneers, Inc. Also
- Any bidder who fails to pay for their online purchases will forfeit
their entire $1000.00 deposit without recourse.
Purchaser
Fee:
Chapter 2175,182 Texas Government Code, Title 10, Subtitle D,
requires that a fee be collected with from the purchaser of surplus or
salvage property to recover the costs associated with the sale. A
fee in the amount of 6.50% will be collected at settlement. Per Texas Building & Procurement Commission Rule 1 TAC 126.3,
the fee will be reviewed annually.
Emission
Surcharge:
As required in rule changes in T.A.C., Title 34, Part 1, Chapter 3, Subchapter O, Rule 3.320 the following surcharges must be collected per tax code. Effective
with those bids open after July 1, 2003 and the auctions held after that
date, surcharge of 2% on the purchase of off-road, heavy duty, diesel
construction equipment.
Sales Tax:
Texas State Sales tax of 8.25% will be collected from all taxable buyers taking possession of their
purchases in Texas for all equipment and vehicles where titles are not available. Texas State Sales tax will be collected
from ALL buyers who do not complete appropriate resale documentation
upon registration for the auction and prior to making purchases. |
