ALL COLTS SELL WITH 1/3 DOWN ON JUNE 21st, 2008, WITH THE 2/3 BALANCE DUE WHEN THE COLTS ARE PICKED UP BY THE NEW OWNERS ON SEPT.13,2008 AT THE FORT RANCH SALE ARENA, PROMONTORY, UTAH

ALL COLTS ARE GURANTEED SOUND , HEALTHY AND IN GOOD CONDITION ON SEPT. 13, 2008 OR THE BUYER WILL BE REFUNDED ALL MONEY PUT TOWARDS THE DOWN PAYMENT.

The highest bidder is to be the buyer.  If any dispute arises between two or more bidders, the sole authority to settle the dispute is to be the Auctioneer as he sees proper, and his decision shall be final.  The Auctioneer reserves the right to reject any and all bids.

2% ONLINE BUYERS FEE WILL BE APPLIED TO ALL PURCHASES MADE ONLINE THROUGH THIS SALE. (In celebration of our 31st anniversary, Fort Ranch will pay the 2% online buyers fee for any horses sold online.)
	
	ALL BIDDER #S WILL BE SECURED WITH A VALID CREDIT CARD

3.6% BUYERS PREMIUM WILL BE APPLIED TO ALL Visa/MC or other Credit Card Payments. (see detailed terms below)

PAYMENT ARRANGEMENTS FOR ONLINE BIDDERS
We will contact you during the bid approval process to verify how you will pay for your purchases
IF PAYING WITH VISA/MC OR OTHER CREDIT CARD, your card account will be charged when you win the bid(s)

IF PAYING WITH CHECK, BANK MONEY ORDER, CASHIERS CHECK or other GURANTEED FUNDS INCLUDING WIRE TRANSFER, WE MUST RECEIVE PAYMENT NO LATER THAN THE END OF THE THIRD BUSINESS DAY AFTER THE BIDDING CLOSES ON SALE DAY.

All bidders are required to register and give full identification prior to bidding and are required to use the number assigned to them when identifying themselves as the successful bidder.  Bidders intending to write PERSONAL CHECKS should provide reference from their bank as to their credit worthiness.  Personal Checks will only be accepted at the Sellers discretion.  Bidders may be required to verify that certified funds, Federal Reserve Notes (cash) or Visa/MC or other credit cards are available for bidders purchases.

Should any Buyer fail to settle for his/her purchases as set forth in the terms above, Fort Ranch Quarter Horse LLC reserves the full power and right to resell the horse to their best advantage, either publicly or privately, without further notice.  Any loss resulting from such resale, and all other expenses incurred as a result of this are PAYABLE BY THE ORIGINAL BUYER

The buyer agrees not to stop payment on their check or stop credit card credit for any reason.  A charge of $50.00 will be made on any check that is returned.  All payment discrepancies will be dealt with to the fullest extent of Utah Law

SELLER RESERVES THE RIGHT TO APPROVE/DISAPPROVE ANY BIDDER

Transportation is the responsibility of the buyer.  However the Fort Ranch can recommend several reputable transporters.

The Fort Ranch foals are not halter-broke, nor have they been handled or touched by human hands.  However the Fort Ranch is glad to assist buyers/haulers with this process.

Papers
Registration papers will be transferred from the Fort Ranch to the new owner via the AQHA after all checks, credit cards and fees have cleared the bank
The buyer must have a VALID AQHA# for processing the transfer with the AQHA
COST OF THE TRANSFER ($15.00) WILL BE ADDED TO THE PRICE OF ALL HORSES SOLD IN THE SALE

Errors

Every effort has been made to assure the correctness of the Sale Catalog, but the owners, Fort Ranch QH LLC,  the Auction Company , HorseAuctions.com are not responsible for nor assume any liability for errors or statements made regarding the horses, pedigree’s etc.
Color
Every effort has been made to list the correct color of these foals sold in the Fort Ranch sale.   HOWEVER NOTE THAT THE COLTS ARE YOUNG AT PICTURE AND CATALOG TIME.  SOMETIMES THESE FOALS WILL CHANGE FROM CATALOG TIME TO SALE TIME AND DURING THE SUMMER.  All changes noted at sale time will be called from the auction block.  We have made every effort to assure the color is correct as stated, however the Fort Ranch, Auction company, HorseAuctions.com is not liable nor able to control any color change.
	
Liability
All persons enter the Fort Ranch  at their own risk (before, during and after the sale)
The Fort Ranch Owners staff, auction company, HorseAuction.com nor any other party connected with this sale assumes any liability legal or otherwise for the safety of the premises, behavior of the horses, or for any loss or damage to person or property, whatsoever

Warrantees
All horses sell sound at pickup time on Sept. 8, 2007
