Terms and Conditions
Reisen Lumber Auction--For online bidding a $1000.00 refundable deposit ($2500.00 out of the US) is required. All deposits must be sent in by 11am Eastern time (10am Central) on 8/18. Further details stated below.

1. Date & Time: Wednesday August 18th, 2010 at 11:00 am 
Central time. 
2. Terms of Auction 
	All property, machinery, equipment, merchandise, and other items are sold on an “AS IS/WHERE IS/WITH ALL FAULTS” basis with no conditions, warranties or representations whatsoever either expressed or implied.  Neither The Auctioneers Group nor Reisen Lumber makes any warranties or representations of any kind or nature with respect to the property or its value, and in no event shall they be responsible for correctness of description, genuineness, attribution, provenance, authenticity, authorship, completeness, condition of the property or estimate of its value.  No statement (oral or written) in the catalog, at the auction or elsewhere shall be deemed such a warranty or representation, or any assumption of responsibility. Please inspect all items before bidding. Preview and inspection dates will be published online at www.theauctioneersgroup.com. Each and every lot will be sold “AS-IS” Specifically but without limitation, Auctioneer makes no representation or warranty that any of the lots: (a) conform to any applicable authority, law or regulation, or (b) fit for any particular purpose, (c) are of any particular age, year of manufacture, model, make or condition. 3. Registration
	Buyers must register prior to bidding at this auction.  All bidders are required to provide accurate and complete personal and banking information and the Bidder hereby further agrees that whether he is acting as a principal, an agent, or an officer or director of a corporation or otherwise in any capacity whatsoever the Bidder is personally liable for the payment of the purchase price, Buyer’s Premium and taxes payable with respect to any and all lots for which the Bidder is the successful bidder at end of the auction. A one thousand dollar ($1,000.00) deposit($2500.00 if outside US) is required to register online.  Your bid is a contract: Place a bid only if you are serious about buying the item.  If you are the high bidder, you will enter into a legally binding contract with The Auctioneers Group.  Registrations will be accepted only up to Tuesday, August 17th 2010 at 4:00PM EDT.   
	The Auctioneers Group reserves the right to refuse any applicant the privilege of bidding or attending at the auction and may revoke such privileges at any time.
4. Deposits
The Auctioneers Group requires a refundable good faith deposit of one thousand dollars ($1,000.00) to register ($2500.00 if outside US).  The deposit must be a bank check, certified check, or business check with a bank letter of guarantee. A sample bank letter of guarantee is posted on The Auctioneers Group website www.theauctioneersgroup.com located under documents.  Your deposit must be made payable to The Auctioneers Group and sent to The Auctioneers Group, 22 Smock Street, Neptune City, NJ 07753.  For customer convenience you can send your deposit via wire-transfer.  Please call The Auctioneers Group at (609) 693-6899 or 732-776-7222 for wire-transfer information.  You must register and have you deposit check at least twenty-four (24) hours prior to the start of the auction.     
For electronic bidders, at its discretion, The Auctioneers Group may contact bidders via e-mail or telephone before or during the sale to provide a bank letter of guarantee or wire transfer as a deposit.  If The Auctioneers Group does not receive a response from its attempts to contact Buyer or if the Buyer does not provide a deposit, The Auctioneers Group reserves the right to refuse or cancel the Buyer’s bids and re-sell the goods.  
5. Inspections
	All bidders, when possible, are urged to inspect the merchandise.  Inspection dates and times are as follows: 10:00AM- 3:00PM August 10th & 11th, 9:00AM-4:00PM August 17th, and from 9:00AM Wednesday August 18th morning of sale.  All sales are “AS-IS and WHERE-IS” and final.  Descriptions have been prepared for guide purposes only and shall not be relied upon by Buyer for accuracy or completeness.  By submitting a bid, Buyer/Bidder affirms that he has inspected all the items or has waived his right to do so prior to bidding.  Buyers shall be deemed to have relied entirely upon their own inspections and investigations.  
6. Invoices & Payments
The Auctioneers Group must receive all payments within 48 hours after the auction, by Friday August 20th at 4:00PM EDT. Payments may be made by wire-transfer, cashier’s check, bank check, or company check when accompanied by a valid bank letter of guarantee. You can view and print a sample bank letter of guarantee at our website, found under documents at www.theauctioneersgroup.com.  Checks should be drawn to the order of The Auctioneers Group, and sent to 22 Smock Street, Neptune City, NJ 07753.  Contact Auction office at (609) 693- 6899 for wire-transfer information.    
Electronic bidders will be sent an electronic invoice and purchase confirmation to the email address provided during registration.  
7. Buyer’s Premium
	A Buyer’s Premium will be charged for all items.  All online purchases via www.bidspotter.com are subject to an eighteen percent (18%) Buyer’s Premium that will be added onto the bid price and will become part of the final sale price. 
8. Taxes
	Purchasers shall pay all applicable state sales or use taxes.  The taxes shall be paid to The Auctioneers Group at the time of sale. Purchases claiming exemptions from taxes must provide proof satisfactory to The Auctioneers Group of their entitlement to claim such exemption.  Proof of exemption includes: valid reseller’s permits, state-issued letters of exemptions, bills of lading provided by shipper for out-of-state shipments. In the absence of proof satisfactory to the Auctioneer, taxes shall be paid by the purchaser.
9. Removal 
	Absolutely no items may be removed before the conclusion of the sale and payment is made in full. No goods will be released without presentation of the invoice marked “PAID”.  All articles purchased shall be removed within the time frame specified by The Auctioneers Group.  
Removal of goods will begin at 9:00 AM EDT on Thursday August 19, 2010. Hours for removal are from 9:00 AM to 4:00 PM EDT. The final removal day will be no later than Wednesday, August 25, 2010 by 4:00 PM EDT.
Purchasers must remove the merchandise from the premises at their own risk and liability.  All purchases are made at the purchaser’s risk and The Auctioneers Group is not responsible if all or any part is lost, stolen, damaged or destroyed from any cause.  The Auctioneers Group shall not be liable for non-delivery to the purchaser of any lots.  
Purchasers shall comply with all environmental laws and regulations and all requirements established by The Auctioneers Group for the removal of articles, including requirements as to bonding of independent contractors. All independent contractors must provide The Auctioneers Group, owner, and landlord certificates of liability and worker’s compensation insurance in amounts acceptable to the above parties. The bidder acknowledges that the auction site is a potentially dangerous place with noxious, corrosive, and pressurized substances being present, heavy equipment being operated and electric circuits being live. Every person at the auction site before, during, and after the auction sale shall be deemed to be there at their own risk with the notice of the condition of the premises, the activities on the premises and the conduct of third parties and the bidder shall so advise his agents and employees. No person shall have any claim against The Auctioneers Group, their agents, employees, or principals for any injuries sustained nor for damages to or loss of property which may occur from any cause whatsoever.
Removal and rigging is to be at the purchaser’s own expense, risk, and liability. All rigging and delivery arrangements are strictly the responsibility of the purchaser and rigging company. The Auctioneers Group and seller take no responsibility for these arrangements whatsoever. The purchaser is responsible for obtaining a certificate of insurance for $1,000,000.00 naming The Auctioneers Group and the seller as additional insured entities. A certificate must be presented to the auctioneer for all heavy rigging requiring the use of forklifts, cranes, etc., whether performed by the customer or a rigging company. The Auctioneers Group has the right to reduce or eliminate these requirements at its discretion.  The Auctioneers Group at its discretion can deny access to an unqualified or uninsured rigger.  
9A. No refunds or adjustments will be made once an item has been removed from the auction site. All refunds and adjustments are solely at the discretion of the auction company.
10. Non-Delivery Responsibility
	All purchases made are at the buyer’s risk.  The Auctioneers Group shall not be responsible if all or any part of such purchase be lost, stolen, damaged or destroyed from any cause whatsoever.  The Auctioneers Group shall not, in any event, be liable for non-delivery, or for any other matter or thing, to any Buyer or any lot, other than the return of the sum paid on said lot, should the buyer be entitled to it. 
11. Failure to Remove & Default
All property must be paid for and picked up in the time frames announced by The Auctioneers Group at the time of the sale.  Time is of the essence.  If not, the merchandise will be deemed abandoned and the purchaser will lose any right, title, or interest that the buyer may have acquired and the merchandise.  In the event the purchaser fails to perform contractual obligations (payment and removal) as specified in this invitation to bid, the purchaser will automatically be placed in default.  The Auctioneers Group will re-market and re-sell this property.  
11A. Payment Default
	Failure to pay invoices in full by the Final Payment Date in accordance with payment terms will subject the Bidder to pay Liquidated Damages.  These lots will be considered abandoned and may be resold at public or private sale without further notice.  And any deficiency, together with all expenses and cost of moving, and re-sale, will be charged to the defaulting buyer.   
11B. Removal Default
	Failure to remove item(s) by the Final Removal Date in accordance with removal terms will subject Bidder to pay as Liquidated Damages the full amount of the expenses incurred to store or transport item(s) until they are re-sold.

12. Disputes
Any disputes as to bidding shall be settled by The Auctioneers Group at its sole discretion and the Auctioneer may, at its discretion, put any lot in dispute up for sale again. The Auctioneers Group is to regulate the bidding and be the sole arbiter. No bidder may retract his bid.  Record of the sale is being kept by the auctioneer and bookkeeper and will be taken as final in the event of any dispute.   
13. The Auctioneers Group will not be responsible for any missed bids from any source. Under no circumstance shall any bidder have any kind of claim against The Auctioneers Group or anyone else if the internet service fails to work correctly during the webcast auction.
14. Indemnification
The buyer agrees to indemnify and hold harmless The Auctioneers Group and Seller from and against all claims and liabilities relating to the condition or use of the articles purchased or failure of user to follow instructions, warnings, or recommendations of the manufacturer, or to comply with federal, state, and local laws applicable to such articles or for proximate or consequential damages, costs, or legal expenses arising there from.
15. The Auctioneers Group reserves the right to add other terms and conditions of sale by announcement at the auction sale, but these announcements do not alter in any way the basic terms and conditions of sale.
16. The Auctioneers Group reserves the right to withdraw or sell any assets contained in this auction without notification.  The Auctioneers Group reserves the right to temporarily or permanently end this auction prior to or during the stated auction period at its sole discretion without notification.  
17. Persons in attendance during inspection, sale or removal of merchandise assume all risks of damage or loss to persons, property, merchandise, and shall exercise proper precautions at all times for the protection of persons and property.  As directed by the Auctioneer and state regulations.  The Auctioneer shall not be liable for any defect in or about the condition of the premises on which the auction is held.  Buyer specifically releases the Auctioneer, its agents and representatives from all liability thereof.  
18. Absentee Bids
	Bidders may submit an absentee proxy bid for the sole purpose of purchasing the items listed when the bidder cannot bid on the day of sale.  All bids are final and binding and do not include any Buyer’s Premium or sales taxes.  The Auctioneers announcements at the time the lot is sold take precedence on any and all published materials. Proxy bidders will be notified only if they have been declared the high bid.  Notification will take place in the form of an electronic invoice which will be sent to the email address provided during registration.  
19. Claims
	The Auctioneers Group will not be responsible for any missed bids from any source.  Under no circumstances shall the Bidder have any kind of claim against The Auctioneers Group or anyone else if the internet service fails to work correctly during the web-cast auction. 
20. Acceptance of Terms
	Any person participating in the auction shall be bound by the above terms and conditions, and the bidder acknowledges he has received, read, and understands the above terms and agrees to comply with and be bound by such.
