TERMS & CONDITIONS FOR ON-LINE BIDDER

CUTOFF FOR ONLINE BIDDER REGISTRATION IS 24 HOURS BEFORE AUCTION START

CDN. DOLLARS (CAD) SETTLEMENT MUST BE MADE BY MONDAY, APRIL 27^TH.

Subject to additions and deletions prior to the sale and at the time of the auction.  All bidders participating in the auction shall be bound by the following terms & conditions.

Auction to be conducted in English & in Canadian Dollars (CAD).

Lindstrand Auctions Ltd. requires guaranteed payment which must be provided by the purchaser by means of the following: 2a,

2(a) Bidders must provide a valid credit card number to register.  All information will be cross referenced for validity.

Lindstrand Auctions Ltd. reserves the right to accept or reject a Bidders registration, and those with incomplete information, invalid credit card, or insufficient funds to complete a hold, as described in paragraph

To avoid delays in the registration approval process, please check accuracy of all information provided.

Lindstrand Auctions Ltd. accepts the following methods of payment: Visa, MasterCard and Wire Transfer in Canadian Dollars (CAD).

Each successful online bidder will receive confirmation at the beginning of the next business day either by phone or by email.  All purchases must be settled in full by 4 p.m. on the day following the sale.  Lindstrand Auctions Ltd. will make one attempt at phoning all winning bidders with the final invoice total and to confirm the method of payment.  If we are unable to contact you, purchases will be charged to the credit card as provided.  Otherwise, payment arrangements can be made by calling 780-672-8478 with your Bidder # as reference.

All articles purchased shall be removed by the Purchaser.  Purchaser is responsible for all removal, dismantling, crating, shipping and related costs, as well as the arrangement of the shipping company.  No exceptions will be made whatsoever.  Articles left behind immediately after the auction and thereafter will be at the winning bidders own risk. Lindstrand Auctions Ltd will not be held responsible for any items damaged, stolen, missing, or left behind.  Please make all necessary arrangements to have your items removed as soon as possible.  Small items must be removed immediately.

Removal deadline is 4:00 p.m. Friday, May 1st, 2015.

A 3% buyer’s premium, capped at $500 will be charged to all online purchases. Also, a 2% credit card fee over $2,000.

A 5% GST will be added to all applicable purchases, any exempt buyers can apply to CRA for a refund.

Terms and conditions are subject to amendments and modifications announced by the auctioneer at the time of the auction.  Sale is subject to additions & deletions, and may include items from other consignors and/or situations.

All items are sold “AS IS, WHERE IS” with no warranties expressed or implied.

The Auction Company reserves the right to accept or reject bids, and to resolve any disputes or discrepancies at its discretion.  The Auctioneers or Auction Companies decision shall be final.

All descriptions & photos provided by the catalog listing is for informational purposes only and in no way a representation or guaranteed implied or otherwise.

The buyer and seller agree that Lindstrand Auctions Ltd is acting strictly as the contracted agent between the buyer and seller. Should any problems or differences arise the buyer and seller agree to deal directly with each other and under no circumstances shall either the buyer or seller take action against Lindstrand Auctions Ltd. The auctioneer reserves the right to revoke any bid number issued to any bidder for any breach, misrepresentation or misconduct performed by the bidder at the auction site. 2. The auctioneer reserves the right to accept or reject any bid and in the case of dispute the Auctioneers decision shall be final. 3. All goods are sold on an “as is where is basis” no warranty exists implied or otherwise in relation to any item(s) and/or good(s) offered for sale unless otherwise announced by the auctioneer at the auction sale. Descriptions provided are a guide only and “do not constitute a warranty or guarantee actual or implied”. 4. a) The auction company is not liable for any mechanical defects found on any vehicle or machinery purchased. All goods are available for inspection prior to the commencement of any scheduled auction and during each scheduled sale. Each purchaser shall be held responsible to satisfy themselves as to the identity, authenticity and condition of item(s) and/or good(s) bid on and shall not be permitted to make any objection after they have subsequently bid on and purchased item(s) and/or good(s) on any grounds whatsoever. Please inspect all item(s) and/or good(s) and vehicle prior to bidding. The auction company does not guarantee the year, odometer and or hour reading of any item(s) and/or good(s) offered for sale”

5. a) The federal governments goods and services tax of 5% will be charged on all item(s) and/or good(s) sold and will be remitted to the federal government under current federal regulation governing the goods and services tax. 6. a) Payment in full must be made for all item(s) and/or good(s) purchased by the conclusion of the next banking day and/or business day from the date of the auction sale before “any” item(s) and/or good(s) are to be removed from the auction premise by the purchaser. 

7. a) Purchases must be paid by Cash, Interact, Bank Draft, Certified Funds or by electronic wire transfer to the auction company trust account. Personal and company cheques are accepted on established accounts only.

8. a) All internet purchases are subject to an additional 3% (three percent) internet fee, to a maximum fee of $500.00 CAD per item bought on the internet. b) All purchase payments are to be made by bank wire transfer into the auction companies trust account no later than 2 business days from the auction date and or invoice date.

f) The auction company is providing the contracted services of BidSpotter.com as a convenience to prospective purchasers and in no way is this to be considered an exceptional right, any disruption in the broadband network and or phone lines that may disrupt the internet biding service will not be held against the auction company or BidSpotter.com there is a potential risk of bids being missed due to system lags or human error that can happen in real time, I acknowledge this risk and agree that the auction company or BidSpotter.com will not be held liable in any fashion what so ever.

All Bidders must provide their FULL NAME, COMPLETE ADDRESS, PERMANENT ADDRESS,DAYTIME PHONE NUMBER & EMAIL ADDRESS at which they can be contacted.

We require a CREDIT CARD NUMBER, EXPIRY DATE and it`s SECURITY DIGIT CODE.

Lindstrand Auctions Ltd and the Seller have made every effort to provide accurate description of all items. However, all property is sold AS-IS - WHERE-IS. It is the buyer`s responsibility to determine exact age, genuineness, value or any other determinative factor. The bidder shall not be entitled to make any objection after the sale on any grounds what-so- ever. 
The bidder agrees that everything is as-is where-is and may not refuse to pay for his purchases for any reason.

In all cases the bidder shall be the sole judge of the item and its value.

If possible we strongly urge the items or items be personally inspected prior to you bidding on 
auction day. 

In no event shall Lindstrand Auctions Ltd. or the seller be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose.

The buyer hereby agrees to indemnify and hold Lindstrand Auctions Ltd and the Seller free from any and all liability, loss, costs, damages, and other expenses arising from the loading or shipping out of equipment on the buyer`s behalf.

All purchases must be paid for in Canadian Funds by Cash, Credit Card (MasterCard or Visa), Bank Draft, or Bank Wire Transfer within 24 hours after the completion of the auction. No purchases shall be removed until paid for in full. A 3% fee, to a maximum fee of $500.00 CAD per item bought on the internet shall be applied to all purchases.

Lindstrand Auctions Ltd is providing Internet live bidding as a service to the bidder. The Bidder acknowledges and understands that this service may or may not function correctly on day of auction. Under no circumstances shall the bidder have any kind of claim against Lindstrand Auctions Ltd. or anyone else if the Internet service fails to work 
correctly before or during the live auction. Lindstrand Auctions Ltd. will not be responsible for any missed bids from any source.

Our on-line auctions move quickly. If you are interested in an item, bid quickly. If you are a successful bidder for an item in the auction, you will be notified by e-mail immediately. Register early to assure your approval for bidding at the auction

The auctioneer has the sole discretion to advance the bidding and may reject a nominal advance, should it, in his 
estimation, prove injurious to the auction. The auctioneer shall be the final judge in all bidding disputes and shall 
name which bidder is the purchaser.

All sales are final. Acceptance of a final bid by the auctioneer constitutes a legal, binding sales contract, pursuant to the terms and conditions stated. Auctioned items are purchased as is with no return option.

The auction company reserves the right to refusal (approval to bid) anyone deemed to be a potential detriment to the conduct of the auction.

All announcements made day of auction take precedence over any and all printed or verbal statements. If you agree to the terms and conditions above, you may register for this event. Registering for this event, means 
you agree to both the BidSpotter.com and Lindstrand Auctions Ltd terms and conditions for this auction.

All property is sold AS IS, and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the 
Bidders responsibility to determine condition, age, genuineness, value or any other determinative factor. 
Lindstrand Auctions Ltd may attempt to describe the merchandise in advertising, on the Internet and at the 
auction but makes no representations. In no event shall Lindstrand Auctions Ltd be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value.

Purchases become the responsibility of and shall be and remain at the risk of the purchaser immediately upon acceptance of his bid. It shall be the responsibility of the purchaser to insure his purchases immediately.
