I. Release and Indemnification:
By agreeing to the terms on this auction, the bidder hereby releases and indemnifies Genemco, Inc., Bidspotter.com and their officers, employees, principals and agents from any and all liability and claims whatsoever, in any way associated with visits to and inspections of real and personal property located at the auction sites in Edinburg, TX, Hearne, TX, North Dakota, or any other location where machinery may be stored, by the undersigned or the undersigned officers, employees, principals or agents.

This release and indemnification shall continue to be in effect for all visits of the undersigned, its employees, principals or agents from this date through December 30, 2014.

II. Buyers Premium:
The undersigned acknowledges that the auction is subject to 15% Buyers Premium on all successful bids. Payments by credit card will further be subject to an extra 5%. Purchasers from Texas will be further responsible for a state sales tax of 8.25% unless a tax exempt status is established. Payment must be received by Genemco, Inc. within 72 hours of receipt of invoice for successful purchases. Any payments for winning bids not received by the stated payment deadline may be subject to sale cancellation and assessment of additional costs not less than the 15% Buyer`s Premium.

III. Terms of Removal:
(1). PURCHASER`S RISK: All purchases made at this sale are at the purchaser`s risk as soon as the bidding period ends, the product is announced as sold by
Bidspotter.com and the email invoice is sent. All machinery, equipment, merchandise and other items (the "Goods") are sold on an "AS IS/WHERE IS" basis. The Auctioneer and principal(s) shall have no liability for any loss or damage to the items for any reason whatever after the bidding period ends and the product is announced as sold. Removal will be supervised and no removal or shipping is allowed until invoices are paid in full.

(2). CLAIMS: No claims will be allowed after the removal of goods from the sale of the premises.

(3). AUCTIONEER AND PRINCIPAL(S) LIABILITY: The Auctioneer shall not, in any event, be liable for non-delivery or for any other matter, to any purchaser of any lot, other than for the return to the purchaser of the deposit or sum paid on said lot, should the purchaser be entitled thereto. Neither the Auctioneer nor its
principal(s) shall be held liable with respect to any item sold in any greater amount than that paid by the purchaser and, in all instances, the higher bid shall be accepted by both the buyer and principal(s) as the value against which all claims for loss or damage shall lie.

(4). Some items may be subject to a pre-priced loading cost. This is the cost for Loading/Removal and is posted on the description for each lot. This cost covers the removal of the items and preparation for shipping. It does not cover any shipping costs. This extra loading cost WILL NOT be subject to the Buyer`s Premium and will be invoiced separately from the winning bid notice. The seller will handle all invoicing, packaging and loading of sold items.

Skidding only is considered w/ loading fees, if additional crating is needed further costs will apply and be specified. However, it is the buyer`s responsibility to arrange for pickup/shipping. International buyers can receive a proposal for container loading and transport to anywhere in world. Estimates for international buyers will be available by request anytime. Container loading may be subject to additional cost. Buyers will have up to 15 days to arrange for shipping. Payment by credit card of any loading or shipping costs will be subject to a 5% fee, which will be added to the total.

(5). Removal of all items from their location and/or all shipping fees, shall be at the expense, risk and liability of the purchaser. ALL REMOVALS WILL BE HANDLED BY THE SITE APPROVED RIGGERS, BY ARRANGED SCHEDULE OR APPOINTMENT ONLY. All shipments must be arranged for and
scheduled before October 24, 2014, unless specific alternatives have been arranged. Certain hand carry items may be removed by buyer with scheduled appointment. No buyer or buyer`s representative may load or remove any lot with a Loading Fee specified.

IV. Additional Information:
All registered bidders will be subject to approval by Genemco, Inc., and bank information will be required.

Payment for all winning lots MUST be received within 72 hours of closing or the buyer will risk forfeiture of the items. Credit Cards are accepted as payment, however any credit card payments will be subject to a 5% fee as noted in the terms and conditions above.

V. Payment Terms:
Company checks are acceptable and must be made out to "Genemco, Inc.". Company checks are subject to a 10 day hold for the payment to clear. VI. Catalog / Bidders List:
All items are listed with descriptions and photos, Identified by Lot #(number). This catalog is a guide only. The auctioneer believes each lot has been accurately
described, however, makes no warranty or guarantee, expressed or implied, as to the accuracy of the information in this catalog. Inspection is welcomed with advance appointments.

VII. Bidder Approval

All bidders must be pre-approved by Genemco, Inc. prior to bidding. 

 VIII. Sales Tax: Texas Sales Tax will apply if the item has a Texas shipping destination. If you have a tax exemption, that form must be received before tax is removed from the invoice.
