  1. Registrant will make settlement in full in good funds for all purchases within 48 hours at end of sale. If not paid on day of Auction a 3% Buyer’s Premium Fee will be added to purchases with a minimum of $25.00 and no maximum. Nothing to be removed before settlement is made. All sales are subject to State Sales Tax Laws. In the event of a non-payment, bidder is responsible for any expenses due to collection.

Bidder acknowledges that sales tax is charged on all lawn, garden and industrial equipment.

 

  1. Registrant acknowledges that the property being auctioned was available for inspection and it is being sold “AS IS, WHERE IS” without warranty or guarantee of any kind, including merchantability or fitness for particular purpose. The descriptions of items appearing in advertising prior to this auction are believed to be correct.

Nevertheless, neither those descriptions or any oral statements made by the Owner (or his agents) or Tom Witvoet Auction Co. (or this agents) concerning any item shall be construed as a warranty, either expressed or implied. I, the Bidder, have examined this merchandise and accept it the way it is. “No Exception”. If you are unsure about an item, please do not bid.

 

  1. Tom Witvoet Auction Co. shall designate the winning bidder after each item is auctioned. If a dispute arises between two or more bidders, the Auctioneer reserves the right to reopen the bidding. Witvoet Auctioneers’ designation of a buyer shall be final.

 

  1. Each item is the sole responsibility of purchaser from the moment the item is sold, even of loss and damage. Buyer should guard their items accordingly.

 

  1. Bidder acknowledges responsibility for any personal injury or property damage caused by Bidder or his agent, and further agrees to hold Tom Witvoet Co. harmless for any personal injury to himself or his Agents and any property damage incurred on auction premises.

 

  1. Tom Witvoet Auction Co. or their Agents shall be held harmless in the event of personal injuries occurring as a result of any physical contact or general usage of items.

 

  1. The Auctioneers are acting as the Owners Agents only.

 

  1. Tom Witvoet Auction Co. reserves the right to reject any applicant for a bidder’s number and/or revoke any bidders number at any time before or during the auction.

 

  1. All equipment to be removed within 30 days of Auction or a $40.00 Storage Fee will be charged per item per day. Item will be sold at next Auction for Storage and Commission Fees. Any remaining balance to be paid to owner.
