Terms and Conditions of Sale
1. There will be a handling fee of 6% charged to all online purchases plus Good and Services Tax of 5% on total
invoice.
2. Notice to U.S. Buyers - United States purchasers
are required to pay in Canadian funds by wire transfer from
their banks or by Visa or Mastercard. Goods that are
exported from Canada by a third-party carrier (broker) with
appropriate documentation are exempt from Goods and Services
tax.
3. All goods must be settled for in cash or by approved
cheque or Mastercard, Visa, Debit card, wire transfer on
sale day and before being removed from the auction site, but
nevertheless become the responsibility of purchasers
immediately upon the fall of the hammer of sale of an item
by the customary manner.
4. There is no fee to register, watch, listen or to
bid. Taxes on fees are applicable to all buyers. No
charges or fees apply to unsuccessful bidders.
5. Our on-line auctions move quickly. If you are
interested in an item, bid quickly. If you are a successful
bidder for an item in the auction, you will be notified by
e-mail immediately. Register early to assure your approval
for bidding at the auction.
6. In order to better serve our customers, all bidders
must provide their name, address, daytime phone number, and
email address at which they can be contacted. This is to
insure good communication between Beaver Hill Auction
Services Ltd. and the bidder throughout any transactions.
7. Beaver Hill Auction Services Ltd. is providing
internet pre-auction and live bidding as a service to the
bidder. Bidders acknowledge and understand that this
service may or may not function correctly the day of the
auction. Under no circumstances shall the bidder have any
kind of claim against Beaver Hill Auction Services Ltd. or
anyone else if the Internet service fails to work correctly
before or during the live auction. Beaver Hill Auction
Services Ltd. will not be responsible for any missed bids
from any source. Internet bidders who desire to make
certain their bid is acknowledged should use the proxy bid
feature and leave their maximum bid 24 hours before the
auction begins. Beaver Hill Auction Services Ltd. reserves
the right to withdraw or re-catalog items in this auction.
8. Individual health papers with a Coggins test will be
issued for the shipment in the U.S. for all horses and
brand inspection where required.
9. Buyers can make arrangements with the seller for
boarding of horses after the sale until they can arrange
trucking for up to two weeks after the sale.
10. All sales are final. Acceptance of a final bid by
the auctioneer constitutes a legal, binding sales contract,
pursuant to the terms and conditions stated. Auctioned
items are purchased as is with no return options
11. Beaver Hill Auction Services Ltd. reserves the right
to accept or reject any bid and shall control the bidding at
all times and all cases of dispute the Auctioneer’s decision
shall be final.
12. All goods are sold on an “as is”, “where is” basis
and any description of goods is set out or offered as a
guide only; Beaver Hill Auction Services Ltd. accepts no
responsibility for errors in description, this is the
responsibility of prospective buyers to inspect the property
before the sale and satisfy themselves as to condition, age,
authenticity
13. If I pay by cheque, I further certify that there is
now on deposit to my credit at the Bank on which the cheque
is drawn, sufficient cleared funds to meet payment and that
said funds will remain available for payment of said cheque
upon presentation.
14. If my cheque is not honored for any reason I
understand that I will face civil and/or criminal charges
which will not be withdrawn
15. I (we) agree to assign any or all properties, goods
or chattels to the selling agent (Beaver Hill Auction
Services Ltd.) under the Personal Property Securities Act in
order that they may recover any monies owing against
purchases whether arising from N.S.F. cheques, unpaid
purchases or uncleared credit cards.
16. The buyer hereby agrees to indemnify and hold
harmless Beaver Hill Auction Services Ltd., and the Seller,
against any and all liability, loss, costs, damages, and
other expenses arising from the loading out of merchandise
by Beaver Hill Auction Services Ltd. and the Seller on the
buyers behalf.
17. If you agree to the terms and conditions above, you
may register for this event. Registering for this event,
means you agree to both the BidSpotter.com and Beaver Hill
Auction Services Ltd. terms and conditions for this auction.
18. I hereby certify that I understand the terms and
conditions of sale and that I will be responsible for paying
for the goods charged me.
