Alkano Ltd. Terms & Conditions for Auction

 

 

1) IDENTIFICATION: All Bidders are required to register prior to becoming an “approved Bidder”. All bidders are required to give full name, permanent street address, phone number and e-mail in order to be registered for bidding. P.O.Box addresses will not be accepted or approved for registration.  Banking information must be shown along with credit card number and Business name.  Subsequently, to registration on Bidspotter, approval to bid is at our discretion.

 

2) Payments: All invoices to be paid by full amount after the sale unless otherwise negotiated with our office prior to the sale and must be in writing. 13% tax will be charged on all invoices, this is required by law. Sales tax will be added to all sales unless bidder has proper exemption form and is produced before the sale. Final payments by cheque will not be accepted unless verified and approved by bidder/purchasers bank. CREDIT CARDS WILL NOT BE ACCEPTED.

All invoices must be paid in full before any items/equipment are released off the premises.

 

3) Mechanism for payment on invoices: All invoices will be e-mailed immediately after the sale and no later than 24 hrs. after the sale ends. FULL PAYMENTS MUST BE MADE ONLY BY CASH, CERTIFIED CHEQUE OR WIRELESS TRANSFER. CREDIT CARDS WILL NOT BE ACCEPTED. The full purchase price on all lots sold to the successful bidder have to be paid within 48 hrs, All payables must be made payable to “Alkano Grinding & Stamping Company Limited.” For wire transfers, please contact Alkano’s office @ (905)335-9777 and you will be advised.

 

4) Removal of items/ equipment:  All items /equipment must be removed from the premises as specified. Small items, tools, machine parts etc. to be removed the next day after the auction sale ends. Machinery and larger items must be removed during the specified period of each sale.

 

5) All purchases shall be removed only after presenting a bill PAID IN FULL.  Removal shall be at the expense of the successful bidder/purchaser. Alkano Ltd. and auctioneer are not responsible for items not being removed in the specified time. For larger items/equipment, there will rigging fees. The bidder/purchaser must make an appointment for removal.  Alkano Ltd.  can help load  equipment in containers or on the trucks.  The rigging fees can be advised at anytime or we can arrange rigger to do so. For pricing, contact coordinator @(905) 335-9777. The purchaser is responsible for expense of rigging and trucking.

 

6) Warranty & Condition of items/equipment being sold.

 Neither the seller nor the auctioneer is responsible for correct description, identification or defects on any items/equipment being sold. The information provided from sources being deemed reliable to Alkano Ltd. and we are not making warranty or guarantees as to accuracy of the information on items/equipment.  No sale shall be set aside nor allowance made on account of any incorrectness or errors made in cataloging or any imperfection not noted or unseen. Descriptions and photos are not guaranteed. We invite all bidders to inspect and verify any item/equipment being sold and decide whether item/equipment are satisfactory for their use.  It is the buyers responsibility to inspect items/equipment before buying. To avoid confusion, bidders are bidding on items/equipment listed in the lot and not on all items shown in the photos. No allowances are made on damaged items/equipment. All items/equipment are being presented for public exhibition and are sold  “as is” “where is”.  Items /equipment are not warranted as merchantable or fit for any particular purpose and no claim may be made by bidder or purchaser relating to condition or use of items/equipment purchased or consequential damages arising therefrom.

 

7) Safety of Items/Equipment

Purchased items/equipment may not have approved or activate mechanisms for operating and safety devices and safety guards as required by OSHA, CCOHS, or otherwise. The bidder/purchaser is responsible for safety guarding and item/equipment to meet OSHA or any other requirements needed before placing items/equipment into operation.

 

8) Indemnification

Bidder/purchaser shall defend and indemnify and hold seller and auctioneer harmless from and against all claims and liabilities relating to the condition of, removal of, or use of item/equipment

Purchased or failure of user to follow instructions, warnings, manufactures recommendations. Or to comply with federal, state or provincial and local laws applicable to such items/equipment, including OSHA requirements, environmental protection agency requirement, or for proximate or consequential damages, costs or legal expenses arising therefrom.

 

9) Claims in Items/equipment

No auctioneer or seller will be responsible for any claims, no claims allowed, after the removal of items/equipment from premises or left on premises past specified time limit for removal.

 

10) Responsibility for Non-Delivery

Neither seller nor auctioneer are responsible for non-delivery or liable in any event, or for any matter, to any bidder/purchaser or on any  item/equipment , other than to return the deposit to on said item/equipment, if the bidder/purchaser is interested at all.

 

11) Compliance with Terms of Sale:

In default of payment of bills within the time therein specified, the auctioneer in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages. Lots not paid for and removed within the time allowed herein may be sold at public or private sale without further notice, and any deficiency, together with all expenses and charges of resale including legal fees, will be charged to the defaulting bidder/purchaser.

 

12) Person & Property Risk:

Persons attending exhibition, sale, or removal of items/equipment assume all risks of damage of or loss to person & property and specifically release seller and auctioneer from liability therefore. Neither the auctioneer nor his principal shall be liable by reason of any defect in or condition of the premises where the sale is held.

 

13) Contract Movers/Riggers:

Alkano Ltd. will be the exclusive Rigger for small items/equipment. Alkano Ltd. will arrange a contractor for larger items/equipment. Charges will be incurred based on individual items/equipment purchased..  Please contact Alkano ltd. office (905) 335-977 for removal arrangements.

 

14) Additions or Withdrawals from sale:

Auctioneer reserves the right to withdraw from sale any of the property listed.

 

15) Dispute between Bidding Parties:

The auctioneers decision shall be final and absolute.

 

16) Sale Records:

The record of sale will be kept by auctioneer and bookkeeper and will be taken as final in the event of any dispute of the sale.

 

17) Riggers and Contractors

Any independent contractors are required to supply coverage of insurance up to $ 2000.000 in order to move larger items/equipment from the sale.

 

18) Reserve on items/equipment:

The auctioneer reserves the right to reject any bid and all bids on lots upon which there is a reserve. The auctioneer or his agent shall have the right to bis on behalf of the seller and get the best possible price for the items/equipment

 

19) Shipping Instructions and Damaged Goods :

Loading of items/equipment on trucks in containers or crating, Alkano Ltd. will be offered immediately after the sale and the price for the same can be advised at any time. Any shipping or loading or crating is the bidder/purchasers responsibility. Any goods damaged in loading or crating preparation will be fully insurance covered. Damaged goods will be scrapped and full amount of money will be returned to bidder/purchaser after insurance claim is   accepted and fully completed. For overseas shipping, Alkano Ltd. will arrange paperwork and  any insurance  required. This expense will be the responsibility of the successful bidder/purchaser.
