By registering and participating in this auction, you, buyer, agree to the following terms and conditions as well as any changes announced at the auction. In order to bid, you must register online and provide a valid drivers license or other acceptable form of photo identification as well as a valid credit card. Your card will be charged the amount of $300. This deposit will be applied towards the full payment. (if you do not purchase anything credit will be processed within 48 hours). Deposit is entered manually therefore you must register ahead of time at least a day prior to the auction. No guarantee that the deposit will be processed during the auction. If bidding on site please bring the deposit in cash. Payment is due in full auction day, cash or wire transfer. Credit card payments will be accepted up to five thousand dollars (5000dls). Balance must be paid in cash or wire transfer within 24 hours. 15% buyers premium + Sales tax (8%) will be added to bid price except for vehicles as buyer will pay sales tax upon registration with DMV. If purchasing from out of state sales tax will be collected and refunded when you send copy of bill of lading. Common carrier must pickup merchandise and deliver out of state. All items must be paid for in full prior to removal. Removal upon conclusion of auction and during the following 2 working days, schedule to be announced. Removal is the buyers responsibility. Items not picked up by due time will be deemed abandoned & your deposits will be forfeited. The Auctioneer reserves the right to take sealed bids/phone bids, accept bids in any increment to the best interest of Sellers, and to reject the bidding from anyone whose conduct or actions are not in the best interest of Sellers. The Auctioneer and Sellers reserve the right to add or delete merchandise without prior notice. This catalog is prepared as a guide and we do not warrant the accuracy, description, age, count, etc. of any of the lots specified. Neither seller nor Abamex Auction Company are or will be responsible for any errors or omissions in the description of the merchandise. Buyer agrees to pay the actual expenses incurred by Abamex or Seller in the enforcement of this agreement or defense of any claim. Buyer should do his/her own independent research prior to purchasing and buyer agrees that buyer is purchasing as is and any repairs/upgrades needed on these products are the sole responsibility of buyer. No returns will be accepted, no monetary credits will be given and buyer won't contest any credit card charges due to any of the above. Under the provisions of Section 24007 and 24007.5 California Vehicle Code as amended 1-1-90, the seller of the vehicle(s) certified that the vehicle(s) might/might not meet California Emission Standards and/or safety check -  buyer would be required to obtain a Certificate of Compliance of Emission Standards &/or repair vehicle to comply with safety check; neither seller nor auctioneer will be responsible for any repairs to the vehicle(s). Vehicles not meeting safety or emission standards are being sold as INOPERABLE for parts only and should not be driven, sales tax will be collected.  Buyers are advised that they will need a one way ticket to drive any of these vehicles which don’t have a license plate or are not up to date. Vehicle(s) are being sold as is where is without any guarantee.  I have read and signed this form prior to bidding.

Truck and Bus Regulation - On-Road Heavy-Duty Diesel Vehicles (in-use) Regulation. The regulation requires diesel trucks and buses that operate in California to be upgraded to reduce emissions. Heavier trucks must be retrofitted with PM filters beginning January 1, 2012, and older trucks must be replaced starting January 1, 2015. By January 1, 2023, nearly all trucks and buses will need to have 2010 model year engines or equivalent. The regulation applies to nearly all privately and federally owned diesel fueled trucks and buses and to privately and publicly owned school buses with a gross vehicle weight rating (GVWR) greater than 14,000 pounds.  Small fleets with 3 or fewer diesel trucks can delay compliance for heavier trucks by reporting and there are a number of extensions for low-mileage construction trucks, early PM filter retrofits, adding cleaner vehicles, and other situations.  Privately and publicly owned school buses have different requirements. The November 13th, 2013 Mail Out MSC 13-28 is an advisory that explains how ARB will recognize specific good faith efforts that owners have made to comply with the January 1, 2014 deadline and how owners can report and take advantage of planned regulatory changes that would increase low-use thresholds, allow owners to opt-in to a number of flexibility options, and receive additional time to comply with the PM filter requirements for vehicles operated in certain areas of California. If your bid price is accepted as the winning bid on any vehicle, you will be charged a buyer’s fee or buyer’s premium in addition to the accepted bid price. A buyer’s fee or buyer’s premium of fifteen percent (15%), will be added to the winning bid. The following is an example of how the buyer’s fee or buyer’s premium will be calculated.  (If the winning bid for example is $1,000 then an additional $150 will be added to the high bid of $1,000). ($1,000 x 15% = $150 ($1,000 + $150 = $1,150 total selling price).
