In no event shall the Auctioneers, any employee, agent or associate of Bartel & Company be responsible or liable for any such warranties, guarantees or the description of any article offered for sale.

 Bartel & Company is providing Internet pre-auction and live bidding as a service and convenience to bidders.  Bidders acknowledge and understand that this service may or may not function correctly.  Internet bidders who desire to make certain their bid is acknowledged should use the pre-bidding feature and leave their maximum bid 24 hours before the auctions begin. Bartel & Company reserves the right to add, withdraw or re-catalog items in this auction at anytime.

All statements in print as well as verbal statements made by the Auctioneer or staff have come from others and are accepted as reliable. Bartel & Company assumes no responsibility or liability for representations made and shall have no obligation to verify or authenticate any statements or claims. Any announcements made from the auction block shall take precedence over any printed information in the catalogues, ads, brochures, signs and any other source.

 All articles in this auction will sell to the highest bidder as determined by the Auctioneer on the floor calling the bids. The Auctioneer reserve the right to reject a bid from any bidder and the Auctioneer shall have no liability for any missed bids.

 If you plan to bid with Bidspotter.com, you must be pre-approved by Bartel & Company.  The pre-approval process is easy but necessary.  Bartel & Company will verify identity, telephone number, method of payment, deposit amount (if any), and confirm your agreement to the Terms & Conditions of this auction.  THE BUYER’S PREMIUM FOR ONLINE BIDDERS IS 13% OF THE HAMMER PRICE.

 A PRE-AUCTION BIDDER DEPOSIT MAY BE REQUIRED AT THE AUCTIONEER’S OPTION.

 If you are the winning bidder, you must make contact with the Auctioneers for Settlement arrangements. We expect full payment to made, as soon as possible.

ALL BIDDING AND PURCHASES WILL BE IN US FUNDS.   

 ACCEPTABLE PAYMENT METHODS ARE: CASH, WIRE TRANSFER, VISA/MASTERCARD OR AUCTIONEER APPROVED CHECKS INCLUDING BANK CHECKS.

 Time will be of the essence. If a purchaser fails to make payment or remove articles within the posted time periods, the Auctioneer may resell the article and the non paying purchaser shall be liable for any shortfall and all costs and expenses. Buyers agree that Bartel & Company shall have no liability for loss, theft or damage of any type to any article, its contents or components.

 No article can be removed from the premises before settlement is made. The Buyer at Buyer’s expense following the sale shall remove all articles from the sale area. Once the auctioneer has declared the article sold, then the buyer shall be responsible for such item starting at that time.

 All sales are final and no bidder may retract a bid made before or during the auction. Buyer shall pay any sales tax due resulting from Buyer's purchases at this auction.

 All articles must be shipped and or loaded out by 12 noon EST, July 24, 2015. No load out assistance will be provided by the seller or Auctioneer. Buyers may use any rigger or shipper of their choosing. Clover Machinery is the preferred rigger for this auction. This facility does not have truck docks.  

 Load-Out Schedule: will be till 5 pm on auction day,

Monday and Tuesday July 20-21, 9-4 pm,

Weds-Friday July 22-24, by scheduled appointment.

 All attendees acknowledge that the auction site is a potentially dangerous place.  Flammable, noxious, corrosive and pressurized substances may be present, heavy equipment may be in operation, and electrical circuits may be live.  All attendees at the auction site before, during and after the auction sale, shall be deemed to be there at his/her own risk, with no further notice being given of the condition of the premises, activities on the premises, and conduct of third parties. All attendees shall so advise his/her agents and employees. 

 All attendees further agree to save Bartel & Company, its agents and its employees harmless from any claims for personal injury and property loss or damage arising from attending this auction or which may occur from any cause whatsoever. All attendees shall maintain their own insurance. Bartel & Company provides no such insurance and is not an insurer of any person, article, or event.
