The term “AUCTIONEER” in this text means “Groupe HCS inc.

1) The highest bidder to be the buyer; and if any disputes arise between two or more bidders, the lot in question shall be immediately put up again and resold, as the Auctioneers may decide. The Auctioneer is to regulate the bidding and be the sole arbitrator.

 2) All articles are sold at so much each. Each lot to be sold in its entirety, from which there is no deviation.

 3) All sales are final and on an "as is - where is" basis, with no express or implied warranty as to fitness for any specific use.

 4) Each buyer agrees to waive the Vendor’s legal warranty against latent defects and more specifically the provisions of Article 1726 -1731 and following of the Civil Code of Québec.

 5) To prevent inaccuracy in the delivery and inconvenience in the settlement of the purchase, no lot can be moved.

6) Each buyer must pay for the whole of his purchase before the lot can be removed.

7) The Auctioneer reserve the right to refuse any applicant for a bidding card the privilege of bidding by number at this auction sale and to revoke such privilege at any time.

8) No sale shall be invalidated by reason of any defect or inaccuracy in any of the lots by reason of their being incorrectly described in the auction pamphlet and no liability shall be borne by the Auctioneer in respect of any such faults or errors. These descriptions have been prepared for guide purposes only. Please inspect lots before bidding.

9) Items purchased shall be removed according to the requirements of the Auctioneers, at the most 3 days alter the sale end or as the instructions given on the beginning of the auction.

10) In case of inability to deliver any lot because of fire, theft, or any order reason whatsoever, the Auctioneer's sole responsibility shall be the return of any deposit paid on such lot.

11) Delivery of each lot shall be deemed to be completed and the transfer of ownership to be effected to the buyer upon award of the bid. The lot shall then become the responsibility of the buyer who shall assume ail risks regarding to said lot and shall be responsible to insure it immediately.

12) Delivery of the each lot shall constitute irrevocable acceptance and waiver of ail claims with respect inhere to resulting from the handling, loading, cleaning, reconditioning, disposal, use of possession of said lot either alone or in combination with ether products.

13) All costs of removal and the sole responsibility and shall be done by the buyer.

 14) No removal shall occur until payment is fully made.

15) No item shall be removed during week-ends, unless the authorization of the Auctioneer be first had and obtained.

16) All taxes in connection with the sale, including federal and provincial sales taxes, are to be paid by the purchaser over and above the purchase price, paid at the adjudication. The Auctioneer reserves the right to refuse Provincial sales tax exemption number.

17) At their discretions, the Auctioneer can, with no liability to the Bidders and without notice: a) withdraw or dismiss a lot up for sale; b) offer quantity of lots as is, or with any other privileges

18) The buyer's requiring help from an employee of Auctioneer, in the moving of his articles, will be personally responsible for any damage cause by any accident on lot bought at the auction. The Auctioneer taking no responsibility for the handling of goods Bought at this auction.

19) All handling charges stipulated by the auctioneer on some lots will be automatically added to the buyer's invoice as well as the applicable taxes.

TOUS LES LOTS SONT VENDUS TELS QUELS EN PLACE

Le terme "ENCANTEUR" dans ce texte signifie "Groupe HCS inc.".

1) Le plus offrant devient l'acquéreur; si un malentendu surgit entre deux enchérisseurs, le lot en question sera immédiatement remis aux enchères et revendu. L'encanteur a le pouvoir absolu de juger et de déterminer l'enchère.

2) Tous les articles sont vendus pour un certain montant. Tous les lots complets se vendent tels quels sans autre alternative.

3) Toutes les ventes sont définitives et tous les items sont vendus en place tels que vus, sans garantie expresse ou implicite quant à la condition des articles.

4) Chaque acquéreur consent de renoncer à la garantie légale du Vendeur contre les défauts cachés et plus spécialement aux dispositions des Articles 172-1731 et suivants du Code Civil du Québec.

5) Afin de prévenir l'inexactitude dans la livraison et les inconvénients pour le règlement de l'achat, aucun lot ne peut être déplacé.

6) Chaque acquéreur doit payer le coût total de l'achat, avant que le lot soit déménagé.                .

7) L'encanteur se réserve le droit de refuser tout candidat pour la carte de mise, au privilège de soumissionner à tout item de cet encan et de révoquer ce privilège en tout temps.

8) Aucune vente ne peut être annulée par raison de défectuosité ou d'imprécision sur n'importe quel lot parce qu'il est mal décrit dans le pamphlet et aucune responsabilité ne peut être imputée à l'encanteur à l'égard de quelque faute ou erreur. Les descriptions des lots ont été préparées dans le seul but de guider l'acheteur.

9) Les articles vendus devront être déplacés selon les instructions de l'encanteur, soit au maximum 3 jours après la vente ou selon les instructions données lors de l'encan.

10) En cas d'incapacité de livrer n'importe quel lot à cause d'incendie, vol ou autres raisons, la seule responsabilité de l'encanteur est de remettre le dépôt de l'acquéreur sur ce lot.   .

11) La livraison de chaque lot sera présumée complétée et le transfert de propriété sera présumé effectué à l'acquéreur lors de l'adjudication. Le lot sera alors sous la responsabilité de l'acquéreur qui en assumera dès lors les risques et sera responsable de l'assurer immédiatement..

12) La livraison de chaque lot constituera l'acceptation irrévocable et la renonciation de l'acquéreur quant à toute réclamation à son égard. De plus, l'acquéreur assume tous risques et responsabilités sans restriction découlant de la manutention, du chargement, du reconditionnement, de la disposition, de l'usage ou de la possession de Chaque lot, soit seul ou en combinaison avec d'autres produits.

13) Toutes dépenses relatives au transport et déplacement des articlessont la seule responsabilité de l’acquéreur.

14) Aucun déplacement ne sera fait avant que le versement du solde entier ne soit payé.             

15) Aucun article ne sera déplacé durant les fins de semaine, à moins que l'acquéreur n'ait au préalable obtenu l'autorisation de l'encanteur.

16) Toutes taxes applicables à la vente, incluant toutes taxes fédérales et provinciales, devront être payées par l'acheteur en sus du montant payé à l'adjudication. L'encanleur se réserve le droit de refuser l'exemption sur la taxe de vente provinciale.

17) Les Commissaires-priseurs peuvent, à leur entière discrétion, et sans aviser l'enchérisseur, ni être tenus responsables à son égard: a) retirer un lot ou annuler la vente d'un lot donné; ou b) offrir des lots en groupes ou avec un privilège quelconque.

18) L'acheteur requérant l'aide d'un employé de l'encanteur, pour la manutention de ses petits articles, sera personnellement responsable advenant un accident ou une. maladresse affectant ses articles achetés à l'encan. L'encanteur ne prenant aucune responsabilité sur la manutention des biens achetés à cette encan.

19) Tous les frais de manutention stipulés par l’encanteur sur certains lots seront automatiquement ajouter sur la facture de l’acheteur ainsi que les taxes applicables.
