Important Information

Procedures for Equipment Removal & Insurance Requirements

 

1.            All riggers must present authorized Gallivan personnel with an original insurance certificate in the amount of at least $1,000,000.00 prior to commencing any removal activities (See below for C of I requirements.

 

2.            Should any pits, floor bolts or hazard of any type exist after removal of equipment, it is the responsibility and cost of the buyer to guard these areas using generally accepted safety practices, such as safety tapes, pipes or bars welded in place, or suitable safety barrier, acceptable to Gallivan.  All floor bolts and/or anchoring fasteners are to be cut flush to the floor and the area left broom clean.  All electric wiring and utility piping must be safely disconnected at the incoming main switch or valve, which will remain in the building.

 

3.            Machines are to be staged for loading in the area assigned by Gallivan personnel.

 

4.            Any hydraulic fluid or oil leaks are the rigger's responsibility to clean up.  Miscellaneous conduit, wires and threaded studs in cement must also be removed.

 

5.            It is the responsibility of the rigger to disconnect all electrical power to the machines.  Please check to make sure the power is off to the machines before disconnecting.  In cases where the seller is responsible for disconnect, you will be notified in advance.

 

6.            No trucks are to be left running in an enclosed building.  Gallivan is not liable for equipment and tools left on the premises.

 

7.            Bridge cranes and hoists may be used only by riggers with crane insurance on their certificate and only with the written permission of crane owner.

 

8.            Liable for Damages - Any surface or structural damage to walls, ceilings, floors, overhead doors, gates, etc. will be rigger's responsibility.  Gallivan personnel are instructed to report damage to the home office and plant personnel immediately.  Riggers will not be permitted to leave with equipment until repairs are made.

 

 

9.          Theft will not be tolerated and we reserve the right to inspect all trucks, toolboxes and rigger cases.  Instances of theft will result in the immediate termination of removal privileges and full prosecution by law.

 

10.          Riggers must present the original copy of the customer's paid-in-full invoice to authorized Gallivan personnel prior to removal of any equipment.

 

11.          Rigger must take full responsibility for and exercise all reasonable care to ensure that there is no release to the environment of any hazardous wastes or substances as are defined in applicable federal, state and local statutes, regulations, rules or ordinances.

 

 

 

 

Valid Certificate of Insurance Requirements

 

Any rigger who wishes to work on location must submit a Valid Certificate of Insurance received directly from their insurance agent, prior to beginning any work.  Certificates of Insurance may be sent electronically to mstephens@njgallivan.com or mailed to our home office at 7170 Zionsville Road, Indianapolis, Indiana 46268.  This certificate must indicate minimum coverage not less than those that follow.  The minimum coverage that is required is as follows:

 

•             General Liability - $1,000,000 Bodily injury and property damage combined.

•             Automobile Liability - $1,000,000 Bodily injury and property damage combined.

•             Worker's Compensation - Requirements vary by state.

 

Certificates of Insurance will be reviewed critically and each of the following items will be verified:

 

1.            The insurance company/companies providing the coverage must be identified.

2.            The policy number/numbers must appear.

3.            The name/names of the insured must be stated.

Named insureds for this sale are Elixir Industries, Inc., 5500 Industrial Drive, Waco, TX 76710, and Norman J. Gallivan, Inc., 7170 Zionsville Road, Indianapolis, Indiana 46268.

4.            The issue date must be stated.

5.            The effective dates of coverage must be specific!

6.            It must include the signature of an authorized representative.

7.            The liability limits must be stated and be equal to or greater than those which are listed above.

 

Certificates of Insurance will be retained on location until all work is completed.  Following completion of the work, these certificates will be returned to our home office to be filed.  The auctioneer has the right to reduce or eliminate these requirements at his sole discretion.

 

Terms & Conditions

Terms of Sale – ELIXIR INDUSTRIES

A Buyer’s Premium of 15% will be added to all bids to determine the total purchase price.  18% Buyer’s Premium will apply to all Internet and Proxy Bids.  Payment for all purchases must be made in full by the end of sale day.  Accepted forms of payment are Wire Transfer, Cash, Guaranteed Check, and Credit Card.  TEXAS SALES TAX APPLIES TO SOME PURCHASES.

 

 

 

Wire Transfers, Company or personal checks will be accepted only if arranged at time of registration.  These forms of payment must be accompanied by a bank letter of guarantee. 

 

 

 

The bank letter must contain the following language:  “THIS BANK GUARANTEES PAYMENT TO NORMAN J. GALLIVAN, INC. FROM (NAME OF CUSTOMER) ON ACCOUNT #_______________ UP TO THE AMOUNT OF $_______________.  THIS LETTER IS VALID FOR PURCHASES MADE AT THE AUCTION ON October 14, 2015, of ELIXIR INDUSTRIES, INC.”  

 

 

Everything sells "As Is/Where Is".  Descriptions are believed to be correct, the auctioneer and the owner make no warranties or guarantees, expressed or implied, as to the condition, authenticity of, or descriptions used in advertising.  It is the sole responsibility of the bidder to verify condition, authenticity and description of any item prior to bidding.  Once the auctioneer says "Sold," the purchaser is responsible for payment and safekeeping of the merchandise.  Removal of purchased items shall be at the expense, liability, and risk of the purchaser.  No abandonment of purchased items is allowed.  Purchaser will be responsible to pay the full cost of removal or disposal of abandoned items.  If Purchaser fails to pay for their items, they agree to pay the difference in price if the item or items are resold.  All bids and payments must be made in U.S. dollars (USD).  No refunds for lost or stolen items will be made.  Announcements made on the day of sale take precedence over any printed material.  Advertised items may be subject to prior sale.

Preview on October 12 & 13th, from 9am-5pm CDT, or By Appointment.  Doors open October 14th at 8:00 CDT for auction.

Removal

Removal of all items must be completed no later than 5:00 PM CDT on October 28th.  Anything not removed by this time will be considered abandoned, and forfeited by the purchaser.
